    May First at 23:45 hundred hours, 2013 was My Last Drink. I Want My CDL Back !!!! Should Be some Time Around June 2014. Just Like Stating Over From The Start. Just saying its a Big F UP !

    I have several opinions on the whole drug/alcohol debate, but not when it comes to professional drivers. Fine to drink with a two night buffer zone, drugs not so much as they are illegal. I will not weigh in with what is worse or whatever, again drivers are expected to be free of any detectable intoxicating substances. That brings up the testing and detectable limits issue. (.04 a menthol cig can get you close).

    That is not why I am here, it just seems to be the prevailing subject so I commented on it. My question seems to fit with the original topic, and although someone mentioned lazy people not using the search function I looked for a better fit, and although I found a few they were extremely old. So in keeping with the original idea of consolidating these threads:
    Misdemeanor (that's hard to spell!) assault w/ deadly weapon by pointing gun (2010), long story but it happened and is on my record (maybe I should have fought harder, but I figured it sounded like about what happened so I accepted it), will this cause problems with getting TWIC/hazmat? Will it cause problems with getting hired? This is not a Felony and does NOT include the phrase "with intent to kill."

    Here are the disqualification time periods for CDL holders:
    http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=383.51

    Quick summary:
    first DUI: 1 year or 3 years if you were hauling hazmat at the time
    second DUI: minimum 10 years, but re-instatement is possible with a rehabilitation program
    third DUI: life

    A couple notes:
    It doesn't matter what you were driving. If you got caught DUI on a bicycle, the above still apply.
    A test refusal is the same as a positive result. Driving is a privilege and by driving you give your consent to testing.

    My personal feeling? Get caught once DUI with a CDL and you should lose your CDL for life. No offense to anyone, but a CDL holder should know better than anyone else the consequences of DUI.

    You're gonna have to explain that "Assault With A Deadly Weapon" situation. There's a lot of picky (and for good reason to) companies out here. Chalk it up to you should have known better than to do that.

    I see prime hires with dui within the last 5 years.

    So do numerous other companies.
