My friend need help-bad psp-decent dac-clean mvr

    Calling Experienced O/O ..i have a friend with a problem,im lost tryn to to help him so i figured with all the years of knowledge my FELLOW TRUCKERS HAVE WILL HELP HIM OUT...Here we go -A good friend of mines is doing the Owner Op thing,hes brought the truck,has the start up money only one prob..He tried leasing on with a container company a while back they told him that he couldnt LEASE ON due to.his PSP POINTS being high-He has no moving Violations,NO ACCIDENTS..NO DUIS..OR DWIS EVER.clean MVR.CLEAN LICENSE..DAC IS CLEAR BUT BAD PSP ONLY DUE TO THE COMPANY HE USED TO WORK DRIVING LOCAL DUMP TRUCKS FOR DIDNT MAINTAIN THERE EQUIPMENT PROPERLY-HES BEEN PUT OUT OF SERVICE ALOT..AT ONE POINT HIS BACK WAS AGAINST THE WALL HE COULDNT QUIT BECAUSE HE REALLY NEEDED HIS JOB,YET HE DIDNT KNOW THAT THESE VIOLATIONS ALL ON TRUCK WOULD GO AGAINST HIS LICENSESo everytime he got Stopped by DOT they wrote the truck up for alot ..and i mean alot of VIOLATIONS..He didnt know that it was goin on his PSP POINTS,they told hime he had 140 points and they only allow 100-they told him he has to wait 24 months for it to fall off his LICENSE for each VIOLATION..He went to the company that he was driving local for and the owner just shrugged it off..Do he have to park his truck for 24 MONTHS AND WAIT FORIT. TO DROP OFF OR IS THERE A WAY AROUND THIS....HIS Other friend told him if he goes with his own AUTHORITY-This point thing wouldnt really matter and that the PSP crap is a bunch of Bull and all companys dont use it because its not federally mandated...What should he do Any suggestions-Thanks n advance

    I think that his only option is to get his own authority and run that way. Or wait 2-3 years for those OOS to drop off. Even with his own authority, he may not be able to secure affordable insurance.

    What he SHOULD have done is refused to drive their unsafe trucks after the first OOS. Then they would have fired him, and he could have contacted OSHA and filed a whistleblower complaint. That would have ended well for him.

    As it stands now, he may still be able to file a whistleblower complaint. I would contact an attorney if I were him.

    I was told by tango they don't run psp because it is not mandatory and makes no difference to customers. They have an o/o division called TMT in ky. Have him check there.

    Thanks guys for your suggestions...he said the only reason he drove was because he needed the money at that time and he was waiting for his lawsuit money to come in...and it came and he left ..do you guys think if he goes the whistleblower route that it woukd actually help if so any good trucking attorneys you know of thanks

    what's he going to blow the whistle on?????

    dot will get him. it's just a matter of time. i think 75 is the threshold to be put on alert. so, if he got 140 points. imagine what the rest of the drivers have.

    it won't be long before dot puts him OOS. and considering that we all need 3 years reference. burning bridges isn't exactly something to be taken lightly.

    get his own authority. or wait a year. his points will be under the 100 threshold for that company he wants to work for. provided he doesn't rack up any more.

    points matter to the driver for 3 years. losing 1/3 every year, after 3 years it's gone. but for the company, it goes against company score for 2 years. after that, it's all meaningless.

    Ok,but i never heard of a ESL Class,and i just talked to him.This is his current situation another owner op put him in touch with another
    O op whos going to let him run under his authority for a small fee,the op knows about the psp crap n said it dont matter because hes not paying $100 or whatever the fee is for the psp program,the op been running for over 20+ years and have a few trucks leased on.He said if that outfit dont work,then perhaps he may put a driver in it.Tell me what you guys think?
