Is this legal? Companies get away with cheating on miles.

I'm leased with a company (I don't want to name it at this time). I pull loads from point A to point B which is exactly 450 miles plus FSC at the national level. ( I think am saying that right ) They only pay out 400 miles plus FSC.


Some of the drivers were complaining about the miles not being accrued ( The town close off access, so you have to drive out of your way an extra 50 miles. It's been like that for 10+ years ) so the company increased the base pay to .13 cents more per mile on that load, so the base pay covers the 450 miles, but drivers still lose out on the FSC miles they only pay for 400 miles.


The company am Leases on too, I received increase on all loaded miles.


But they are back to the old ways of do business, only paying me 400 mile to go from point A to point B, they know dam well its 450 miles. That's why they upped the base rate the first time, ever since the rate increase I received,they are back to there old ways. When I checked with PCMiller it says 451 miles one way.


Since my contract states it pays me by the miles plus FSC ( PCMiller is stated in my contract how they determine their miles)


So I emailed the company's terminal manager about miles being short, the answer I was given:

Unfortunately with the increase overall we've given the Terminal, I cannot make adjustments for one lane. We got rid of all the jumbo's to simplify things. Hopefully you will look at the overall picture of the increase and not limit the areas you run.


Only if that was true, I go to five other places where the miles are off, they upped the bases pay to cover those miles also, but not the FSC.


Can they do this legally knowing that's 450 miles and only paying 400 miles and on FSC.
Do I have any legal grounds to stand on, to me this looks like fraud.

 

Yes , my contract say PCMiller. Haft the routes I have are set rates, most are good. They do pay me 3% more FSC above the national ave.
i have to go through my settlement every week I always find a mistake. I do hold payroll feet to the fire every time. I shouldn't have to do this every week.
