I would secure another job before going down the legal route. Suing your previous employer while finding an new employer is 'awkward'.

Actually, sorry to say, but the company can say that you were primarily fired for leaving the delivery site with product still in your tank.
They can say you were negligent in not verifying all the product (gasoline) had dropped before you left the delivery site.
Note: I'm just thinking how the employer would be thinking.

File for unemployment, even though you were terminated. You may lose a few weeks or a month of benefits due to being terminated, but if this turns into a longer period between jobs than you hoped, you will still have some money coming in.
They'll also give the employer a chance to give their version of what happened..

Eight years hauling gas, just move over to a better company. You know who they are.

P.S pulling over and draining down on the side of the road wasn't a great move. Just sayin..

I am not trying to make excuses here. Def shouldn't have bucket drained on side of road. I was headed to the rack and didn't want to probe out. Stupid of me to pull over and check tho, for sure.

You should be able to do something if they falsify your DAC report...

If those witnesses are willing to step up and say that they have knowledge of him saying this then there could a case The most you could hope for though is to be reinstated as a driver. In this business the term "protected employee" is all but nonexistent. Good luck.

I just spoke to HR who told me they have my file and have found no fault in anything I've done. They are now going to involve my RM. Problem is RM and TM are buddies

I hope they will reinstate me. I don't want to sue them and I don't want their money or for anyone else to lose their job. I only want my job back. I enjoy my work and my company. This whole ordeal took me by surprise.
