I would bet that I have been fired more then anyone else on here. I have a real low tolerance for stupidity. I have never sued a company to get my job back and have never been offered a job back. So, I am not speaking from experience. I am in my third year of law school while driving over the road. Yeah good old Taft U.
If you were fired by a company because a person lied about you, then you sue that person. It is an act of slander. If you take it to court and win a judge can order the company to reinstate you as well as giving you your back pay. That is a hard case to win without witnesses. If he made those statements to HR, then go to Human Resourses and get them to back you up as to the charges he made. It is then up to you to prove them to be lies. It is not up to him to prove they are true. All of this takes time and money. Sometimes that works in your favor because it also cost him and the company money. Do you want to fight? Get a lawyer. But the company will fire you the next time.
My advice is seek employment elsewhere but appeal your firing up the line at the company. Also, send a letter to your Congressmen and ask him to look into the matter. Most of them will write a letter to your company asking for an investigation. That usually puts the fear of the lord into them.

Thank you for your comment! I have been trying to explain exactly what you just stated to anyone who would listen! I couldn't understand how my TM could call me in his office and fire me without any proof as to the allegations against me. He didn't even bring the mechanic who said these things about me into the office so I could defend myself. Then to fire me over an alleged major spill but not call safety, risk mmt, or EPA? Makes no sense. I just hope the RM listens.

If things don't go your way, you can also call the EPA and let them know that your company failed to report a spill, see what that does for them. As for not wanting to get anyone fired, I would be all for having the guy that lied about you and the guy that fired you.............out pounding the pavement looking for a new job.

It sounds like Rollinsteady has handled this with a cool head so far which may win out in the end if actual facts are released and logic is followed.
Its hard to say if calling the epa is the right thing to do. Do they deserve it? Yes they do but sometimes in a small world environment like certain professions can be those types of deals follow you around and can hurt chances for employment with other companies. Youre right! I'm hoping things will work out. I'd actually still like to go after the mechanic because of the false accusation he brought against me, even if I remain with the company. I have an excellent reputation in tank town and to slander my name this way isn't right. Would I be able to keep my job should I go after him legally?KnowledgeSponge Thanks this.

Thanks for that MJ1657! I am hoping that my behavior toward this situation will prove that I have nothing to hide. I only want to continue doing my job. I'm just hoping when presented with the facts, the higher ups will see that there's a reason no one went through the proper channels required for an actual spill. It never happened!
