Just because you live in an at will employment state doesn't mean you can't sue for wrongful discharge. You just have to have an extremely good case and an extremely good lawyer and a lot of money for legal fees. By the way if I was seeking legal advise that would effect my life to this extent I think I would seek it else where.

Maybe not a good move to get EPA involved. By telling them that your company "failed to report a spill" is somewhat admiting that you had a spill....especially if you identify yourself (which you might do in order to gain credibility in such a claim).KnowledgeSponge Thanks this.

There was not a spill though. Certain people from the company claimed the op had a spill. If the op did have a spill it would have been the companies duty to report it. They did not report it because it appears this spill is a made up story from someone with an ax to grind.Rollinsteady Thanks this.

I was thinking the same thing. I won't say they failed to report a spill because there was no spill. If I call and tell them that my employer failed to report a fictitional spill that never happened but I was fired for, they'd probably laugh at me!KW Cajun and GoneButNotForgotten Thank this.

Im glad you see it the way I do! It's messed up that one person is able to cause myself and my family such worry. I just want for everyone (HR, my Regional mgr,) to see where I'm coming from. Also, when I called Saftey he knew it was non sense. He's the one who told me to call HR

Please keep us posted on how this turns out Rollinsteady. I battled something similar to this but very different circumstances a couple times when I was in management at a car dealership. Its not fun but worth sticking with if you're truly in the right.
I got great satisfaction when accusers were basically ##### slapped for making up stories to get me fired. When it was all done after the facts became clear I just went about my business and did not act hostile or upset with any of the accusers. I had fellow driver tell a lie about me one time. a bad one. I did not wish him any punishment by his act. although it could not & did not cost me my job, it could of cost me some respect as far as my reputation & character. over time, like a couple weeks,months, everyone knew who the honest one was. I told the owner of co, it was my request that the liar not be punished. he did more damage to himself, by himself. that was a couple years ago. the lord has a sometimes peculiar way of closing one door & opening up another in a way, that you do not see until later. my open door allowed me to make a huge change that I am thankful for.

When the concept of seniority is introduced you not only have to worry about doing your job well, you also have to worry about the backstabbers and brownosers. It's pathetic.

The posts about finding another job first are great advice, going in the back door is slow processes and the suggestions about using the failure to report to EPA thing is an example of that. Replace the job, then get your satisfaction. If you really just want to work for a place, that will effectively hate you for doing this to them, you might try and tell very senior management your are going to drag them into a long discovery process to expose every little thing they would have, should have, could have done, not to mention the stuff they are legally obligated to do but did not do. Maybe they will just pay you off to make go away or hire you back for a while.
Note I have two jobs last over 10 years, each one had people force the company to reinstate them. I have never known any employee to succeed and be happy with the out come. At best you are that guy no one trusts, at worst, you'll get nickels and dimmed with procedure violations until you quit.
Your biggest problem is you want the job back. That job is gone for ever, you may get the position back, but the environment will never be the same.Last edited: Jan 21, 2014
