You are right.
However, if companies were truly paying the driver for the work they have to do, then there would be less time at the docks because the driver would have to be moving to justify the cost of the load. Only then will the driver be compensated correctly and dispatchers put to the task of production.

Being paid buy the hour would solve the problem. but the ATA doesn't want that. they are not for safety. They want a screwed up pay scale were they can fudge books. I know a company that was paying drivers under the table for the miles they ran off the log book.
-
As medical tech is today, there is no way to test for too tired. Any subjective test will be tore apart by the legal system.
I believe that being paid for all hours on line 3 & 4, would do away with most problems in trucking. You would do away with most speeding, and aggressive truck problems in traffic.

It truly doesn't matter what the ATA wants.
You, collectively, have more power, more say in the rule makings than they do.
All that needs happen is to get coordinated & petition the government for what YOU want.
The hell with the ATA.
It seems everyone is too scared of the ATA to buck their wishes. -
I don't think it's about proffit like you want to believe. I think it's a time where drivers need to stress their opinions "that make sense" to DOT so maybe they can understand a little.
Pay has nothing to do with your log sheet. Your log sheets reflect what you are doing every 15 minutes! I can pay you to sleep for 24 hours if I want to!
So lets not relate logs to pay!
What you drivers do need to do is get together and make sense out of some logic (keeping the public in mind) rules
. If you can come up with some then by all means write the DOT your thoughts
.
Just voicing your negative thoughts isn't doing any good except making you look like a whinner/no one that has a "real" opinion. So figure something out .
I have my thoughts and have stressed them. -
Logging Legal, is not as easy as it sounds. I thing what hurts the drivers most, is the waiting between loads. Its very hard to log sitting for 8 hrs before getting loaded, and then have to make delievery the next morning.
IF DOT would just allow the CLOCK to STOP while waiting, and then after loading the CLOCK WOULD START AGAIN AND NO TIME WOULD BE LOST...
If this could happen I bet the LOGS COULD BE LEGAL!!!!!!!
I think the public citizen group should look at this, instead of trying to take more time from the drivers!!!!!!!!! -
Baloney. Drivers should be paid for all time on duty. Just like everyone else.
-
DOT and public citizen want the clock to keep running. If you could stop the clock more drivers would hide unloading and sitting at dock time. They do not want tired truckers on the roads. Public citizen wants you to have 12 hrs line 3&4 and then 12 hours off.
Mark -
Why do you think the clock was made to keep running?
Because in the previous HOS, hardly anyone stopped working & regularly cheated on the HOS. -
While I understand but lets say you drive 8 hours then get held up 6 hours loading/unloading and you have to assist. Then you are expected to drive 3 hours. You have now been up 17 hours, wow that boss of yours is really cracking hte whip and you are wore out and don't want to but since it's in the regs they expect you to and you tend to do it because DOT says it's ok.
So to a point these rules today are for your protection of being over worked also!
But I see your point and know what you are getting at
