The company I am with uses the Qualcom E-log system. There is a function on ours where we can have the logs faxed to a DOT officer or scale house. We can do ours right from the truck and we don't have to call anyone. Either that feature is not active on his or he just doesn't know how to use it.

I called Landstar and of course as usual nobody is in there in logs at 1145 at night. I called QUALCOMM they said its broke no signal since Monday night 9pm last reading. I explained to the dot I will try to get the last 8 days since I just had my reset. We waited an hour for QUALCOMM to fax logs with no luck. -
This was when I called them at the scale house duh to have them fax it

Short answer - yes. Fabricate the last seven days on paper. Ridiculous laws require ridiculous measures.
Do what you gotta do to keep everyone happy. DOT cop would have been happy, LS would have been happy and you would still be happy (I assume) at LS.
Right now no one is happy. -
Well how can u fabricate 8 days when it's there responsibility and Quallcomm if my unit breaks to be able to provide me what I need of it breaks in truck

I appreciate that because most of these drivers making these comments haven't been in this situation . They probably would have endured the same thing considering I was only 20 min from my house. I sat in that scale for an hour waiting on them to fax . I watched them bring everyone in and was keeping a running tally of how many tickets each one stopped and where able to write up. I understand they have a job but a drivers expense not right at all. Best of all they weren't no older than 30.

Well now that makes sense. You got hosed. So much for mercy or understanding when you were trying to do the right thing. Guess they just wanted that ticket for they're numbers. Wonder if going to court and appealing to the judges common sense would help.

Funny/sad story happened to a friend at CR England. He was on an EOBR and got pulled in for an inspection. They wanted the last eight days. So, he went to the qualcomm and had it faxed. It took awhile, but finally the fax showed up and NONE of the times matched with what his qualcomm was showing him. The truck #, load #, trailer #, and his name were correct. But, it was showing sleeper during on-duty, driving when he wasn't, etc. He even begged the DOT officer to come back to his truck and look at the screen on his qualcomm. They did, and agreed that according to his qualcomm screen he was legal (only about 8 hours or so into his shift and not against his 70). However, the paper copy claims he started his 14 well over 14 hours ago and showed Line 4 for all the times he wasn't listed driving. They didn't shut him down, but still put the violations on his inspection report (not current, and falsification). However, the DOT officer told him to get it straightened out with his company and didn't place him OOS. No fine, either.
They knew the system had garbled the data somehow, because his device in his truck was showing accurate, but still nailed him with the violations.
Luckily, my entire time with an EOBR, I only once had to fax my logs to the scale, and it was only a few months after my friend's ridiculous encounter. Luckily mine were spot on except a time when Line 4 wasn't showing up near the start of a day (showed Line 2 still). They really went over that printout, calculating when it showed I started my shift and when it showed my shift ended to make sure it didn't exceed 14 hours. However, they never care to calculate the 11 hour or 70 hour.
