40 pounds over on trailer axles do you return to shipper to get re-adjusted .. again?

    Most states allow 80,400 lbs if you have a APU.

    The exemption, which was signed into law by President George W. Bush in August 2005 as part of the Energy Policy Act of 2005, increases a vehicle's maximum gross vehicle weight limit and axle weight limit by 400 pounds. This allows for the adding of qualified idle-reduction technology, such as an APU.

    Agents or brokers being sneaky and lying to drivers has been going on for many many years. But 25 and more years ago many loads were done on a hand shake type basis unlike today where the personal touch is seldom encountered. Now it seems we are either a truck or phone number or an E mail address to them. Cheap labor comes to mind.
    There are some things I will not haul. I will not haul to grocery houses unless they are under construction. I will not haul a load if a lumper is required. It matters not who is paying for them.
    I will not haul a load if I don’t have a POC and phone number, address and a confirmation on the load including the rate & weight pickup and del times and dates..
    Back in the medieval days of trucking I did onions, potatoes, watermelons, Steel. Lumber and cars, pulled a reefer , van and moved electronics and a few unmentionables and changed my own tires. I do miss the good old days. The golden days of trucking. Today I am very picky where I go and what I haul..

    40 lbs. is nothing. As long as you are under gross, just don't look guilty crossing the scales. :biggrin_25519:

    I think we need to team up McScrup's trainer with the Werner trainer from that infamous thread. He'd spend half his shift cleaning the driver's seat! Lol!

    Since you're with a Trainer, I'd guess you have to do what he tells you to do but I don't think many scales would bother you as long as you're not over 500 over. Some will even allow 900 as long as you're not over gross. Some will let you slide to get legal. Some will let you move your tandems all the way to the rear to get legal. While its true, sliding your fifth wheel doesn't remove weight from your trailer axles, it does remove weight from your drives so you can slide your tandems to get weight off of your trailer. Me, personally, I would not worry about 40 lbs but its his job to teach you to be legal. If he don't do his job, he will get in trouble so I couldn't say hes being an ######### because 12,000-34,000-34,000 or 12,000-34,000-40,000(If spread axle) is legal. You'll learn the allowances once you're on your own. Never seen anyone lose their license over an overweight ticket. Have seen some pretty hefty fines for being overweight, especially overgross.

    Honestly? Your figures aren't adding up. The axle weights you give only amount to 79,860, instead of 80,140? Aside from that, I would have slid my fifth wheel one notch forward and slid my tandems one notch backward and went on down the road.

    Ok since im kinda in the over 5yrs catagory---Honest answer--I've spent more time typin this reply than I would have spent pondering that scale ticket.....and in the time it took the OP to write out their post I would've been 20miles down the road.....

    Certified scales weigh in 20 lb increments so no biggie. In all fairness, You did the right thing to get it legal but took a longer time to do than necessary. Now you know. Hopefully Lesson learned.
