A positive drug screen result

    Opinions don't mean much. Neither do subjective medical reports.

    I agree SOME people are clueless.

    But your blanket statement, is unfounded. 3 miles a day jogging? Or, 100 feet walking? Which person is in better health?

    The guy who smokes and jogs?

    Or the guy who doesn't smoke, and doesn't bother with some form of workout?

    I "used" to do 3 miles a day and smoked 2 packs a day. Probably still would if I hadn't punished myself with other "healthy" activities when I was younger. Hard to believe I know.

    If my smoking bothers you...move your treestand over the next hill. But, I seriously doubt you walked the 3 miles with 50 lbs of equipment, then waded through that "nasty/unhealthy" swamp to get anywhere near me.

    my situation was different i was arrested for driving while impaired,(no alcohol) i was taking my perscription medcine and had a bad reaction i guess>any way im trying to drive team with my son
    whose clean.WERNER told him they will take me because it was over a year ago.(june 06) (huh)i didnt think anybody would take me. also is there any suggestions as far as hiring a lawyer to see if i can some how get that off my dmv as such?

    Unfortunately, the answer is no. It would be a huge waste of your money. Time is the only thing that will remove it.

    While many people are unaware of it, the law applies even to over the counter meds.

    I don't think what you did makes you a bad driver off course if you was doing that while on the road I do. You took the risk and now are going to have to pay for it. I myself don't smoke it and have drank 3 times in the past 16 months or so but I am not going to sit here and act like I am all mighty or even better than you. Just need to use your head and think before you do!!! I have known and heard of alot of drivers doing 10 times worse. Just don't give up but you do need to make some changes, either stop the drug or stop trucking, anyways good luck man!

    my question is, i failed a radom, i know dumb ### mistake. but i was offered a job driving a truck and the owner doesnt check with previuos employers. its a small local company. what would happen if i took employment there (yes i will legaly pass a drug screen) will i be in violation? its not on my state cdl correct? could my previuos employer track any job i take and rat me out?

    Legally the employer that you are applying to MUST do a back ground to include a employment check for the last 3yrs. This check must include drug screen results. If he doesn't do this HE is in violation of the law. As for you your only worry is when/if something happens and a lawyer digs into your past and finds it and uses it against you.

    If the carrier doesn't do past employment checks then you, and/or the carrier can be issued a federal fine up to $27,500.00 especially since you put it in writing on here (where many federal & state officers look) and since there are computer databases where a cop, be it federal or state, can find out where you work, especially if you didn't go through the mandated part 382 evaluation and substance abuse training process, and since a cop can subpoena your information from people who produce/own websites.

    I would like to thank you for some of the advise that you had given to me. Now that I have seen the SAP and have done what he's asked me to do and have complied 101% and more, he's doing the return to duty status report for me ( i guess to SWIFT and to Dept of Transportation) I am guessing i'll be set to return to work after 2 yrs out of a bigrig. can you please explain why a company would deter to hire me even if i've never touched a drug in my life. I'm going to answer all questions on an application truthfully, what advise would you give a guy trying to explain what went wrong between himnself and the company that had it out for him,,,, thanks for your time
