I might say I hope the party will be ok or I hate they got hurt but don't think Id say Im Sorry at the scene of an accident, it could be construed by a court or jury as being an admission of guilt. And no, you haven't lost your humanity, the world has taken it from you, especially if you are a trucker.

Did you bother to ask the safety department of your company, or are you simply making guesses? I just covered this topic in training. A cellphone becomes evidence in accident cases, and anything on it can be used against you. End of story. You don't have to agree with it, but that doesn't change it one bit. You're going off on some nonsense about the cops confiscating the phone, which is not what I said at all. Feel free to take as many accident pics as you want with your cellphone, but don't be surprised if it comes back to bite you in the ###.

I was raised by a Photographer. He was called in at times to take pictures of murders. A photograph is not evidence, it is a historical record. You are taking a cell phone picture of something that has already happened. That is different from taking an actual photograph of the crime taking place.

I would point out to you the 8mm tape of the Kennedy shooting. That film is privately owned. It does not show Oswald shooting anyone so it is not evidence. It can become evidence if it is introduced in court.

When the Boston bombers blew up the marathon everyone was asked to turn in there cell phones and cameras, all people with stores were ask for their videos. No one was forced to give up anything. It was voluntary.

A dash cam that has an actual record of the accident is evidence. So if an accident has happened just maybe another accident needs to happen.

And my safety department went exactly the opposite direction, and told isn't on take pictures with our phones if they were available.

Since you're so certain of your assertions, please post your proof. I've already done so, and I feel I've done enough to prove my point.

That makes the case for making sure I get a copy before handing it over--he11 if I'm giving away the ONLY proof of my innocence!!

I think I might have a simple solution for the dash cam. Just make sure the first thing you do is pull it off the wind shield and stash it. Then take it to your attorney later. Let him figure out whether to share it or not.

Workable solution. It'd be cool if it could upload the video automatically to a cloud account, but that's be dependent on connectivity.

If it's a minor accident where you know it's your fault then stash the cam while the cops are on the way. If it's a major/deadly wreck it doesn't matter anyway since they will search the truck.

Sending to the cloud would be simple. Just use a tablet with cell coverage and send it to a Gmail account.
