Hourly pay for loaded miles only... Is this legal?

    They definitely broke the law, minimum wage laws, department of labor law, I would contact department of labor and fill a wage complaint form.

    Fisrt off, did they read their employment contract? Word of mouth means nothing if something different is written in the contract. If there was no contract, then word of mouth stands and she MAY have a case. If their was a contract, she should get paid how the contract specifies. There is nothing illigal about paying only certain hours. They can pay you however they want as long as its agreed apon prior to working. Ay change in rates only applies to hours worked after the chage was discused. Likley, the contract specifies how she is paid

    If you keep seeing a job opening for some outfit the first question is why. It's the same culls every week. They're stupid/greedy ahole. What a nightmare to hire new ppl every week or so. After awhile the whole town knows.........stay away.

    If he's a contractor on these trucks he probably signed something saying only loaded miles pay him and that's his choice to do that for himself. When he becomes an employer to people though, he's regulated by all the labor laws of California and has to follow them. Even if he hired her signing something saying no paid unloaded miles, which I doubt, it won't stand.

    i won't apply to jobs that are constantly advertised.

    in utah, we're paid by the hour. the only operations that pay by the load. are basically double belly dumps doing some type of long haula. (county to county)

    Hi okiedokie, fer sure. I check CL like once a week, just in case that miracle job pops up (as if) and I'll see a certain job, then it's gone for 2 or 3 weeks and then, there it is again, so you know it's a crummy job, someone tried it and quit. I suppose they are trying to catch someone that hasn't seen it. My ex-gf works for a trucking co. in a small town, it's true, they literally went through all the available drivers in the area, and can't find drivers now. BTW, cool rat rod cab over, although, I heard those spikes on the wheels are illegal in some places.:thumbup:

    Sounds like false advertising to me ,not only that sooner or later this company will hire the wrong driver to steal from most drivers i know drive for their families so this would be a serious offense ,causing hardship on the family ,imagine how a man would feel watching his kids do without because another man told him a lie and didn't pay him according to an agreement .....i wouldn't want any part of this ....neither the man that got ripped off or the man that will be caught and shot in the head .....there's no way this can be legal or we are all in big trouble
