If the inspect the truck and trailer they can clearly see that there was an issue and what not no problems. The problem will come once they inspect his logs. If his logs are found to be incorrect and or falsified then Leo and lawyers would argue that if he/she ran legal then the death, or accident wouldn't have occurred as the driver wouldn't have been there in the first place.
once Leo's can determine no fault to truck driver then they will deal with car that hit him.
We all are guilty til proven innocent but good ole lawyers and Leo can find something to make it the truck drivers fault.

ACCORDING TO another thread started about this very same accident.

Looking at the pics it appears he was on the shoulder side of the white line. Not that it would have mattered, the article states that he ran over all 3 of the safety triangles.

It doesn't matter how long the vehicle is on the shoulder or for what reason. A safe driver(car or truck) will look ahead, maintain following distance to have time to react and avoid probkems, and get over a lane when passing anyone stopped on the shoulder. This car was halfway onto the shoulder when it struck the vehicle on the shoulder! Would it even have mattered if the truck was 2" over the white line? No.It's very obvious that a lot of people are just prejudiced against trucks by the way they ignore car drivers' blatant disregard for safety but exaggerate and spin facts to convict truckers!One_tooth_wonder Thanks this.
