Hello,
I am a new owner operator. I recently bought my truck and I havve started working in Houston, Texas hauling asphalt, previously was hauling crude.
I have a CHL, and I was curious, and I have been searching online, is it a Federal crime to carry your gun inside your truck? Being that it is Hazmat?

No it's not a federal crime. Just be careful crossing state lines. Every state has different laws and some can cause you a lot of problems if you bring a gun into their state (Illinois and New York come to mind).

This has been beat to death, but here it goes again. There are no Federal or state laws that distinguish a difference between carrying a firearm in a commercial truck vs private automobile. Obviously, we are not talking about security guards or armored cars. If your carry permit is good in the states you travel, you're good to go. Where things can get interesting are when private facilities ban firearms on their premises. If your state makes this a criminal act, and they don't have a bring your gun to work and leave it in your car law, you can have issues. Signs posted in FL hold no weight, as long as you leave if it's discovered your carrying. Failure to leave immediately results in charges. Each state is different in this regard. Ports and military bases are always a no-go as well. Only you can determine if carrying is ok for your application. Also, the carrier you're leased to(if you are) might prohibit it as well.

While it might not be considered a firearm by the ATF, a loaded BP pistol could easily get you a weapons charge depending on where you are. Heck the state of NY classifies a loaded magazine separate from a firearm, as a firearm by itself.Cetane+ Thanks this.

I asked this to someone I knew that had been driving for about ten years now. They said that as long as it is locked in a safe, if stopped, they cannot look through personal belongings in certain situations. I do not know and sure would like a clear statement on this and believe they should allow drivers to carry in all states because that is basically your home away from home.
