I disagree. Its up to the O/O to make sure they are displaying the proper information on their truck when they operate it. How and a carrier be responsible for insuring that someone isnt showing their information when they shouldnt be?
Its the O/Os truck and business and their responsibility to show valid information on the truck.
EX Driver is driving under with my signs on his truck. Is it even Legal?

Been there and have had that done to me a few times. Not anything you can do(criminal)unless you embellish what happened. FMCSA doesn't care what name is on the truck, only that the authority is good. And the carrier is responsible to make sure their name is off the truck when it leaves. Unless he makes a claim under his insurance there is no fraud.

it is easy, all ya have to do is stipulate in the lease agreement .
and if it isn't against the law , what would stop anyone from putting anyones name or numbers on the truck?? if ya aren't leased to anyone any longer its a violation.drvrtech77 and Ubu Thank this. -
Thats what I was thinking.
I doubt the FMCSA would look the other way if I put Landstars info on my truck if I was not leased on to them. Just because it is legal authority for some dose not making legal authority to anyone.
The authority is not good if the carrier (the OP in this case) is no longer allowing him to operate under it, is it?
The truck is not the carriers property so I am not sure that the carrier has a right to even touch the guys truck, let alone remove anything from it even if it is signage displaying their information. Seems like they would just be leaving yourself open to a law suit for damaging his paint or some other made up nonsense. . -
FYI- In my time as an O/O, I've been leased to 2 companies. In both cases, my lease said that I had to return all "marks". This meant the name, dot numbers and IFTA stickers, even if they were in little pieces. They wanted them sent in to them as part of my processing out of the company. I didn't have a problem with it.

Never said the carrier must remove the signs. Most carriers will have it in their lease that all company info must be removed from the vehicle before final money's are paid.
No one "stole" the identity.
