Can a company mandate using sleeper status during 10 Hour Break

Technically and according to the law you are generally not supposed to be logging line 1 while at a shipper or consignee waiting to be loaded or unloaded. Makes sense. You're generally not allowed to wander off and do whatever you want under those circumstances so you're not off-duty. Logging line 2 in this scenario doesn't really makes sense to me so I've never done it...if you're on duty and attending to loading and unloading then declaring it okay to snooze in the back seems silly IMO but whatever, I don't make the rules. Maybe I should start doing this to save my 70.Last edited: Jan 24, 2015

I would agree with what you said but i think there is an exception to that rule....
someone can correct me if i am wrong, but if a shipper/reciever require you to be in a drivers room / breakroom, while being loaded or unloaded then one can legally log 15 mins for checking in and bumping dock, and the rest of the time can be logged off duty.
(as them requiring you to be in an off duty area gives the driver permission to be off duty)
this was always my understanding on this issue otherwise all time spent at shipper / reciever needs to be logged on line 4. -
I used to log sleeper time as off duty..
I had a KY DOT ask me one time where I slept while off duty.
I had no hotel receipt.....so guess what! I got a ticket for it!
Now if i'm in the truck 10,12 hours or whatever I log sleeper.
No rule saying that you can not exceed 10 hours sleeper time that I know of.
No big deal logging it all on one line. -
Yes, If they specifically release you from duty in some fashion, such as allowing you to leave the premises to eat or requiring you to be away from the vehicle, you can log line 1. I've been called on that before by a DOT officer. Told him I was given permission to leave the truck and walk across the street for lunch (while it was spotted on a door). I don't think there is anything in the rules regarding how long you need to show in the sleeper if you're not teaming or 8/2 logging. I just log it more or less like it happens...if I slept 7 hours that night I log 7 hours on line 2 and 3 on line 1 (at minimum to make 10 of course.)

Lol, Is this a normal habit of yours to wake up in the middle of the night to go buy stuff? Normally when I go to bed I just lay there unconscious for a good 6-8 hours.
You were also saying you're unable to edit your logs? They must not be Qualcomm because I know they allow edits of anything except line 3 driving time. (Only after you've approved a log for the day are you no longer allowed to edit it.) -
he/she a sleep walker, and has to account for time when he/she is walking in his/her sleep...shhhhh......don't wake em...

Dude I'm just walking in to give paper work or collect paper work. Not hanging out in the driver lounge. Not at the dock. If they even let you do it. I know the truck is done cause it ain't moving from the fork lift. I'm going back and take a nap. No and I ain't sitting waiting for you to call me on the CB its broke. Call me on the cell if you must or walk on out and get me. Not going to happen me sitting there waiting for a CB call.
I usually log around 30 minutes. Off duty. I'm not loading or unloading, driver count, or am I the supervisor. Its on them. Check the trailer when I get done, close the doors, and haul ###. The only time I'm logging on duty if its a requirement in order to get detention pay or being paid in some other fashion. -
And no there is no stipulation I have to be awake or on duty in order to be paid by the company for dentition pay.
