I can pretty much guarantee that neither Wal-Mart nor Kraft will EVER have to settle a case like that. They have massive teams of lawyers that will (quite successfully I might add) argue that a) it's private property and they can tell anyone to leave at any time they want to b) once off the property the company isn't responsible for any decisions made or actions taken by the driver c) the driver should have planned his hours better to allow time to leave after being unloaded and d) the driver could have always opted to be towed and therefore would not have violated any laws.
The drivers and/or carriers will always lose in cases like this.

flatbed companies usually don't have DC's or whatever for parking. and not all allow it. and even less in states like cali.

Yes, I understand what they are. Its NOT the American Truckers Association. They represent the industry as a whole. Some see paper logs as freedoms, while carriers see them as archaic and costly time consuming to manage. Carriers using ELD for HOS Compliance and IFTA reporting can save considerably on office staff and reduce fines. This is the reason many drivers using ELDs can still make money because the company is saving money elsewhere.

is it unreasonable to believe that those of us that run loose leaf actually drive legally and pass audits and still make money? all of that minus the micromanaging. beyond comprehension for most i am starting to think especially those that go to the mega outfits and become indoctrinated to the elog whether through osmosis and the trainer they are assigned or the orientations or both. i vote both.

Really? Funny, none of their staffers have ever asked my opinion on anything, and I'd imagine the same holds true for most everyone on here. But these ####### somehow represent me... after all, if they represent the trucking industry as a whole - as you've stated - then it must be all inclusive, right? So how is it that they often find themselves at odds with OOIDA and other organizations? Guess they feel like they're not represented by the ATA, either?
It's a lobbying group representing office jockeys for a handful of large carriers, with the intent of forcing everyone else down to their level under the guise of "safety". Or do you think it's mere coincidence that everything they propose gets immediately touted by the likes of C.R. England, J.B. Hunt, H.O. Wolding, Crete, etc? The day I need C.R. ####### England and company telling me I need their EOBRs and to be limited to a speed they dictate in order to be safe is the day the ####### universe implodes.
So, then the carriers should be free to choose their method, correct? If paper logs puts competitors at a disadvantage (which you seem to be implying here), why are they pushing to mandate the e-logs, ELDs, and EOBRs? Or is it just coincidence that those will be extremely costly systems which will really put a lot of smaller carriers in particular in a bind?
And that's the prerogative of carriers who opt to use them. Are you really so naive as to believe that what you stated here is the purpose of the ATA and company trying to force these things on everyone? Seriously? -

I wish one of those major corporations would get sued for that. It might make them realize the simple answer is the best answer. UNLOAD THE TRUCKS IN A TIMELY MANNER.

I assume you are a company driver? What does your dispatch say about this? If dispatch told you to roll then it's difficult to blame the shipper don't you think? Or didn't you call dispatch?
If you are the boss then tell them to call the police because you ain't moving. They might tow you and you might never load there again but those are the breaks.
