The real truth about lumper fees.

    I have scanned most of this thread, and read posts 74-80 above ^ ... and it all still seems about as clear as mud.

    Who or what determines just exactly what the commitment, obligations, responsibilities are for the driver that just backed his 53' reefer up to the dock??

    New-B here so please bear with me. Is it determined by: the origin shipper, XYZ Freight Company (for company or L/O drivers), some other entity in the middle, the policy of the receiver / warehouse, the whim of the guy that you deal with on the dock ..... all of the above ?? If I should get my wife to ride with me, is it OK to make her my designated lumper ?? (Be careful now)

    I have other "lumper" questions, but let's start with that for now:biggrin_25519: .

    The point that CAJUNSPICE makes about insurance seems like a valid one ?? Does anybody know if your company's insurance coverage stops where your trailer meets the dock ???

    If you are required to unload your company does NOT provide a lumper, and you get hurt, BOTH the Dock and Your employer are jointly responsible. The DOCK for requiring the driver to load/unload (against Federal Law) and your employer, because you were performing a service on behalf of the employer.

    Been there, done that.

    I know this does not answer your question, but in the 80's and 90's I just flat out refused to load or unload. As a company driver I would stand my ground with the shippers and recievers and between the before mentioned and my co. they somehow got the truck loaded or unloaded without my help.Now I caught some flack for this but it had to begin somewhere with drivers like me refusing to do it. When I was an o/o I would unhook from the trailer at the dock and tell them to deal with the co. because this is my tractor you have the trailer. Guess what before I got off their grounds bobtailing they would stop me and say that they would load or unload the trailer. Heck, other drivers used to tell me it was my job but after running the way I ran for a co. I just did'nt see it that way. In those days I ran more miles than a team I was not about to fingerprint any freight. As for nowadays we don't fight that fight anymore, but if you have to , just plain stand your ground.

    RK - I'm not sure I follow you - are you indicating that it's against fed law for a driver to load/unload (be on the dock), or that it's illegal for the dock to require the driver to unload/load if it's against the driver's company policy?

    Can you point me at the statute so I can waive it in the faces of the iggernant?

    I click on "User CP" to see which threads I've responded to have recent activity. By posting in this thread, when y'all post new posts, I'm notified, and know to check it out.

    Before I dispense with any answers, I have to be absolutely sure my answers are correct. Ain't my style to pass on bogus information.

    Roadkill mentioned "Been there, done that" -- so I'm thinkin' he'd be the best to answer the questions.
    I'm confident he won't steer us wrong.
