HELP: New driver & contract

    Hello everybody,
    I'm looking to add my 1ST driver.
    Anyone have a driver contract I can modify and use??
    What should and shouldn't be in the contract?
    How many months should the contract be?
    Hold the first check?

    one thing you must do full payroll ,deduct SS and taxes and have a workmans comp ins policy on the driver..the IRS website will give you all the info, classifying the driver as a contractor filing a 1099 IRS form on him is not legal

    No dont hold the first pay check, you start playing with there money you will lose in the long run, Do ss, sdi, state and fed withholding, if your not sure use a payroll mangement company.

    o to your local comunity college take a business mgnt class or 2.

    Can anyone please tell me where I can get a sample contract for a driver for at least 3 months.

    can anyone post a sample?

    You need to explain what you mean by contract.

    Is this an o/o you're leasing on? Who's truck? W2 or 1099 etc..

    I think he means a company policy handbook. If so just make your own up. You know how much you're going to pay,how you're paying and when. List everything you expect them to do and the events that will result in suspension/termination.

    It would be unwise to use someone else's contract ... get a lawyer to write one up for you that reflects your operation and your business needs. I can tell you the contract can be nullified if you just copy it - I know because I've gone to court and did just that.

    The duration is until it is cancelled.

    Spell out the obligations, the responsibilities and other things like who does what in case ... in it. ALL for both parties.

    Talk to YOUR accountant as if you are going to even need one if they are going to be an employee, or if you can do the 1099 thing which a contract is important.

    DO not be a cheap owner, this is a business and it takes money to get it right. Too many cheap owners are out there and we don't need another one.

    I would hold checks back at least a week on employees. You read about it on here all the time how guys never get their last paycheck. What they don't mention is how they tore up equipment or something stupid like that.

    I don't want to copy someone's contract, but I don't want to create 30 pages from scratch either.

    does OOIDA have a driver contract?
