Question about getting stuck

    Ok so over the winter I ended up having to get a tow truck to get me unstuck a couple time.The first time was back in Feb where rain froze around my tires in the middle of the night and I could not get the truck moving no matter what I did.The 2nd time was a month ago and i was at a shipper whos lot was all dirt and it was raining that day and trying to turned around to park my drives got caught in some mud.Now that I have left the company Werner I was working for I have been turned down by other jobs cause im being told on my dac report that werner put it down that i totaled the truck both time and if that was the case then why was i still in the same truck that I got 6 months ago?

    Now my question is can it really be put on my dac like that to be counted as a accident or is there a way I can fight this?

    File to get the Dac corrected, but first get a hard copy of that report and inform them "Werner" this is slander and false reporting and see if they want to get sued for false claims,
    Why did you not get rock salt and de ice your self and then the mud thing, well I was not there,

    Werner is fibbing. That's not nice. Inform the people at DAC what happened, and that you want to file a rebuttal. Informing Werner about the slander lawsuit you're filing is also a good idea.

    Contact DAC and fight Werner's BS.

    Carry rock salt and a shovel in the winter months.

    Use extreme caution and G.O.A.L. on any ground that may be iffy.

    IF that is how it truly is then you truly need to consult an attorney. It is what it is at times and if so,this is one of those times and i do not believe in frivolous law suits. jim klepper or whatever trucker attorney can give you free advice.

    It is one of them yea I should of had salt with me but when I left out I was not thinking about bringing it with.But being stuck in the mud I will take that but what I wont accept is them saying it is a accident.

    I'm so glad I don't drive a company truck then because I get stuck every year at least once, without a fail. I think I'm the king of getting stuck in snow,ice and mud.

    Companies like to lie on DACS.I'm surprised Werner went to this extreme though saying you totaled the trucks.I would call them and ask them about it.

    What I do and you may see other "old timers" do this, is when I was parking at say a truck stop, I'd make tracks in the snow, by backing up, moving forward, several times. This also packed down the snow. Others, especially dumb rookies would often walk by me and laugh. I had the last laugh when I could get out of the piled up snow.

    I also did this at many loading docks that the ground was snow covered. I HAVE TO do this at my Maine warehouse, as by the time I get there? The snow plowing contractor is NEVER there!
    And even though I drive a day cab, I carry along a 5 gallon pail of either kitty litter or speedi dri.

    If I can take along that, in a day cab, then anyone driving a condo sleeper can certainly find room for the same thing. It's one of those things that for survival, one needs to be constantly aware of doing.


    Can't say I ever got stuck in mud. I always tried my very best to call my company and tell them the possibility exists that I will get stuck. There had been times I was told to skip that place. But when on your own, and no one to call..??

    I could be that there was "some damage" to the equipment in the pulling/towing process. None of us were there, and he provided no pics to back up his claim. many times, (as I remember it) once a tow truck is sent out, it is either an accident or incident, but I am leaning more towards accident as the cost will be well above "incident level".

    Could be too that when he was assigned the truck, it already HAD previous damages and he did not cover his arse by reporting it, and again, taking pictures. All we have is "his word", and frankly no proof of his claim.

    If I were a betting man, I'd put my money on pre-damaged, unreported by him. And this is why he got nailed.

    Last year I got stuck in mud after delivering funeral wreaths to a cemetery. I had to back out down a narrow winding dirt road, the ground was soggy and my wheels sank into some two feet of mud, luckily the grounds keeper had a dozer and pulled me out.
    This winter got stuck at a truck stop when parking the truck slid backward and trailer got hung up on a snow bank, passing hopper driver was nice to yank me out of that one.
    Only once I had to call for a tow, this was years ago in Oklahoma at some shippers yard, their roof caved in from the snow and no one was around.
    By my count in 5 years Ive gotten stuck at least eight times. Sometimes I can dig myself out other times I have to rely on the kindness of others.

    Well... I realize that no one would ever come on to TTR and post something that was not 100% true and completely accurate... which is why when someone post that a company put something false on their DAC.. we can be certain that it is true...

    However, something is not adding up for me here... I drive for werner and werner has its policies and procedures... one of which, is when a driver is involved in an incident or accident they are routed to a terminal where a safety hold is placed on them.. which means the guard will not lift the gate for the driver to leave the terminal.. so in order to leave the terminal the driver needs to either crash the gate.. not recommended... or go see SAFETY.. where an incident or accident review is done... then they are put on probation and assiged CBTs (Computer Based Training).. usually about 3 of them... also, when the Safety or Incident review is done the driver reads what was written in the report and the action taken and writes whatever comments they want to write and signs it... the company keeps a copy and the driver is given a copy...

    So, if werner ever did put something false or inaccurate on my DAC.. It wouuld be very easy for me to fight because I would have my copy of the initial accident or incident report that the werner safety person and I signed stating what happened, all costs involved and what if any action was taken.. probation, CBTs, simulator training, whatever..

    Which is one thing I like about driving for a mega.. the checks and balance system they have can be used to your advantage.... in this case.. to fignt their false reporting on your DAC.. just show them the original report of what happened....

    Also, as stated in an above comment... if ever a tow truck is needed.. if you have any incident or accident.. no matter how small.. take pictures with that disposable camera they give you when you are assigned a truck.. and you can get at any terminal.. I keep a few in my truck... cause if I have an incident or accident.. I am taking several pictures from every angle of my truck and the whole area around it... I will go through 3 cameras if I need.. but I will have every thing documented in pictures... my truck had to be towed once cause some sensor went out.. I took pictures of my whole truck while waiting for the tow truck.. and I am glad I did.. cause when I went to pick it up two days later.. after a lovely stay at a clean hotel with a swimming pool and hot tub.. yay.. well, my truck had a ding in the left fender.. they tried to say it was there when they picked my truck up and even showed me where the driver noted it on his slip... which before I called them on their BS.. I took pictures of the slip... then informed them that I had pictures of the truck right before it was towed and there was no dents or scratcnes on it anywhere.. for my efforts and photography.. werner gave me $50... before you go saying that is chump change... werner did not have to kick me anything for doin what any responsible driver should do...
