OOIDA may be able to point you to a lawyer. Not sure why you would he seeking legal advice from truckers when I doubt any of them went to law school.

You do realize this is one in the same don't you? I would still get a lawyer, but mostly to see about getting turned into a reduced ticket or whatever. Moving foward, please start taking responsability for your actions.

I don't know that I "didn't" hit her. Clearly, I did hit her. However, I never saw her in front of me, there was no real impact, and didn't put 2+2 together when I noticed her talking on a cell phone on the shoulder of the road. I feel bad about the whole situation and agreed to pay for her damages because I am TAKING RESPONSIBILITY for the collision. It wasn't like I crashed into somebody, smashed a car behind me backing up, and then side-swiped three cars fleeing the scene of an accident. I heard something, thought I got rear-ended, and got out of the truck twice to investigate.
I was just browsing through the FMCSA website. It said something about a DOT Reportable Accident requiring a collision AND one vehicle being towed from the scene. This was a very minor collision and nobody got towed. What is the difference between DOT Reportable and a point on my record?AfterShock Thanks this. -
Because I trust truckers far more than I trust lawyers! Plus, I'm sure somebody on this site surely has experienced a similar situation. This a whole new experience for me. I've never even been in a wreck in a car! Hearing other peoples thoughts, advice, and experiences is a valuable resource prior to speaking to a lawyer, because lawyers tend to overcharge when faced with a client who doesn't have a clue!MJ1657 Thanks this.

Btw, Can anybody recommend an average priced dash cam that would be good for dump trucking? I spend a majority of my time off-road in extremely rough, dusty conditions. What do I look for in a dash cam? There a zillion different dash cams on Amazon.

I'm not from Commiefornia, but if the report says what it does, why would you get a point. The cop doesn't get to put the points there, all he does he write the citation that goes through the bureaucracy where some button pusher enters the data. If you didn't get a ticket, and aren't listed at fault, just how is this point supposed to get assigned?

I would also hire a lawyer immediately. I am sure she has time to develop a medical issue. Just cause she doesn't say she is hurt today doesn't mean it can't come up in 3 weeks.

Having over 20 years in California law enforcement, before retiring and becoming a trucker, I do not believe they can. Were you issued a ticket, or not? If not, I have a hard time believing they can do this. Check your driving record to see if this alleged point shows up.
I'm inclined to think you happened to get a jerk cop who was pissed because he had to write a report, but couldn't take legal action against you. So he just decided to play mind games with you.
