I just finished CDL school (paid for it myself) this past Sunday June 8,08. I was suppose to go to a trucking company at the end of this month to start my trucking career (won't say which one in case they are on here but they are in Texas and most of you dislike them). However I received a letter from a lawyer saying a warrant had been issued for me from something I did a year before and I turned myself in yesterday June 9th. It is Theft by Deception (White Colar Stuff), but That's a Felony. I already think I know the answer to this question, but I'll ask anyway.
Is it safe to assume my trucking career is over before it even starts?
What I did was wrong and I regreted it before the warrant was ever issued. I originally decided to get into trucking for the medical and retirement benefits. But after being in school for the last 9 weekends I truely grew to love and appreciate what truckers do for this country . I am 45 years old and although bad because of being a felony this is the only trouble I have ever been in. I did what I did because that company screwed me out of money repeatedly. As far as the out come goes leagally I will most likely get put on probation and have to pay restitution and will not go to jail for even a day. But the excitement of driving a truck and having a career that could support my family now seems only the end of a dream that never started. It will probably take over 1+ year before this will ever go to court but I will still have the bad reference from the ex-employer.
Please any openion or help would be truely appreciated. Especially if you can tell me if any company would ever hire me.
    Thank you all in advance,

Well, yes and no. First, on your app. it asks if you have been CONVICTED. If you haven't yet, say no. Should you get hired, keep your nose extremly clean. Do not give your co. a reason to look over your shoulder to see if you are stealing from the co. After 2-4 months, go in and talk with your supervisor and explain what is going on. It's obvious that you will need time off for your court apperances. The best thing to do, keep your new co. informed. After it's over, I can pretty much guarantee that your co. is going to seriously moniter you for quite some time.

If this company terminates you before all takes place, well, then you're pretty much screwed. That will put you down to maybe local gravel/asphalt hauling until you aren't too hot to handle.

First step - Admitting mistake. Yes, it's costly.

    Second step - Rebuild yourself.

Good luck to you, I hope this helped some. Never been in your shoes, but been on management side looking. It's not pretty.

    Hey I80 RW,

Thanks for the reply. I actually have a pre-hire letter from the company. I actually applied about 3 months ago. I was approved to go to their school on April 21st but decided to go to a local school to cut down to being gone for 8 weeks instead of 11 weeks. I told them I was still interested in working for them and they sent me a pre-hire letter to my school. I am suppose to go to orintation and training on June 28th. Do you think they have already done by background and employment or do you think they won't do that until I get to orintation and start training? If they have already done that then I will go ahead and go to Texas. But if you think they wait until you get there then I may as well not waste the time and money to go there. Please let me know your thoughts when you get the time.

    Thanks

Some companies will hire even with a felony. You can check on line, that's where I saw it.

i think any major co will dump you on curb the moment they find out. I would get job close to the house in case this happens and try to find a company you can confide in.---- if your not up front with them ,every day youll be waiting for the axe to fall. call a couple of other companies and just ask them ,nothing to lose if they say no.

I know for a fact that I had a warrent when Werner hired me, I didn't know it AT THE TIME but I found out a short while later. I don't think warrents show up. But mine was minor traffic related, not a felony so...

I do know Werner HAS hired felons, in fact most of their GRA GRA people are ex-cons. Or so the story goes. I know someone whom was on felony assault or something charges, had to wait till his probation was over before Werner would hire him, but hire him they did.

The best bet is to talk to the perspective employer now, if you have never been in trouble before I'm willing to bet they will give you a chance.. Good luck in your cout apperance, and hope it come out good..

Fester, you need to put away those trucking dreams for a while if you haven't been convicted . You didn't say what your status is exactly, so I will assume you have NOT been convicted yet.

You need to fight this felony tooth and nail. Make sure it gets busted down to a misdemeanor at least. Getting it dismissed somehow would be better, but beggars can't be choosers. You don't want a felony on your record in this day and age. It's too hard to find good jobs as it is. Throwing a felony in would give gatekeepers an excuse to exclude you from consideration when it comes to good jobs later. This is because society loves to use felons as their ##### examples to keep straight people in line. Don't fall into this hole.

If you get a job with a trucking company, you won't have time to fight the charges later. You will be surrendering, meaning you'll soon have a felony conviction following you around like a little puppy dog until the day you die. And if you don't fight it because you're stuck in a truck 1500 miles from the courthouse on your big court date, you will be hating life doubly so later if you quit trucking and walk away. The felony is NEVER going to walk away. It'll become your third leg or second nose. Where YOU go, IT goes.

Take care of this legal issue first, and THEN go get a trucking job.

I agree with Tip. Fight this tooth and nail. Hire an attorney and make him earn his pay. A plea bargain to reduce the charge to a misdemeanor and restitution perhaps. DO NOT PLEAD GUILTY until you have discussed it with an attorney YOU HIRED ,none of this public defender BS either.

JLKK called it. Hire a great lawyer for sure. Public defenders are cheap, sure, but using one may make it appear as if you don't really care about your fate in the courts. Today the justice system is more of an industry, meaning it actively pursues victims and convictions. This approach keeps the jails full, plus it weeds out people from consideration when it comes to good jobs on down the road. Also, giving the system an excuse to marginalize you means you won't be a political squeaky wheel later. He who has a felony in the coming Darwinian storm won't have any credibility, so rioting in the streets won't get him anywhere.

Hire a great lawyer and fight, fight, fight. Appeal it if you get convicted and start again. Keep it up until it becomes a misdemeanor or even gets dismissed. Show 'em you give a #### about your fate.
