    Alcohol is legal. But behind the wheel you have an entirely different set of laws to follow. (Some states call it DUI other states call it DWI.)

    Exactly. The op was asking about rolling his own off duty though.

    As I recall, the statement I made is still applicable to alcohol.

    We simply follow the more strict rule. Correct?

    Yes you follow the more strict rule. Off Duty in a truck can still be public intoxication. It would have to be at a residence to be legal.

    Look at it this way.

    If you were allowed to smoke on your days off this would defeat every purpose of "random drug" tests. no?

    My point being if you're a truck driver with common sense you would have thought about this before coming on to a forum of people of opinions and asking a question as such.

    Fear the federal law not the state law.

    Actually, on the subject of alcohol, I was under the impression that being in the truck drinking (or having had a few drinks outside the truck) off duty was fine. The rule being that you need at least 8 hours off duty from the last drink before you can be on duty again.

    Being drunk as a skunk is obviously unacceptable... Lol

    No one on this forum will admit they smoke pot and give you advice on how to do it. hahaha
    and you are governed by federal laws regarding your cdl not state.
    You are not allowed to smoke dope as a trucker. Thats the rule. If you wreck into someone you will get a drug test right away and if you fail, your done. You could be looking at jail time depending on what you did or didn't do.
    Just find a different line of work. Your better off.

    Good god truck drivers will never be able to smoke pot fine. Some of you overly self-righteous people need to pull back on the reins a bit , half of you fat ##### are on some form of medication for your blood pressure because your fat out of shape and drink coffee and smoke cigarettes all day.I don't condone smoking weed it makes you lazy and stupid but I notice it's always the driver buying a 12 pack for his 34 restart and 3 packs of smokes who has the most criticism for the pot head.

    i was going to say something about all the self righteous 500lbers who act like pot is meth and crack mixed with heroin. all while they suck up meds from doctor and use a breather machine cause they are to fat to breath.

    Heh... My primary criticism for pot is that it's illegal. You may read that as I protest the fact that it is illegal or that I criticize pot smokers for doing it while it's illegal. Doesn't matter because both would be correct.

    In truth, pot is less addictive and harmful than cigarettes. Both to the smoker and those around them. That being said, it's still a drug with sedative properties.

    I will say that I condone use for MEDICINAL purposes only, and I do mean legitimate purposes. I'm hesitant to be okay with it for recreational purposes, primarily because it's a drug that people will abuse much like alcohol.

    That being said... Whatever a person uses any drug of that nature for is their own business, legal or not. Your choice, just don't blame anyone but yourself for the consequences.

    But unless that person is 100% clean and stays clean, they don't belong behind the wheel of a dune buggy on a deserted beach or a 4-wheeler. Much less an 80,000lb vehicle.

    There's a special place in my heart for the dumba** that says they are better than drug seekers or users just because they don't do drugs. I have a news flash for all of them... Cigarettes are a legal drug, but you're still "doing drugs" as it alters the chemistry in the brain. If you "inhale" caffeinated beverages because you can't live without your caffeine... Guess what? You're on drugs. Again, it's a legal one but it is still a drug. Lastly, those of you who decide that you need more sugar in your ice cream or that Cinnabon... Guess what? Sugar is a drug too.

    The major difference between the three legal drugs I mentioned and pot, meth and the like? Legality and availability.

    But we love to ignore the major similarities... All 3 of those legal drugs can and do take away from your overall lifespan when used in excess. Oh, and you can be addicted to all 3 as well.

    I'm sure this will stir up a flurry of people... But the bottom line is that the major thing we all forget is that just because it's legal doesn't make it better.

    If you are in an accident,drug/alcohol test required only if you are cited. Or unless you display signs of DUI.
