I'm a fairly new Trucker, which I love dearly, But I have questions, I need answered. Today I was fired for being Late, After my haul of course. Upon leaving I was escorted to my Truck to remove my belongings, I grabbed my old logs since I started working there, incase I needed them. The guy escorting me, literally grabbed all my logs out of my bags (yellow copies) and took them and refused to give them back to me. He said they were the companies property, and since I'm not a driver, I can't retain my yellow copies. Is this true?? I know theres a few discrepencies in them from them not allowing me to take a 30 minute break, but making me log it, so I don't know if this is why they took them. Any help is appreciated.
Got Fired, have a few questions.

And you just let them take your logs? Spines come in handy you know.
ramblingman, tinytim, icsheeple and 8 others Thank this. -
They did it slyly as I wasn't looking, being an Army Infantry Veteran, I was ready to pound his face, but I held myself back, what do I do? I'm assuming they can't take them?
-
Well, I di have a spine, as I was deployed multiple times, What was I supposed to do? Beat the #### out of them?rachi Thanks this.

No you are entitled to retain copies for personal/tax purposes. In fact, if you are OTR or otherwise travel away from home regularly, you will need this if you choose to use standard daily meal allowance option at tax time and to backup your claims. Even guys who are on eLogs are able to ask the employer for that log data up to 6 (or 3?) months back.
Sorry for your dismissal. Hope everything works out.MrEd Thanks this. -

lol, we are, had a few problems with my father ended up in the hospital for life threatening injuries that I informed my supervisor about, and still got a write up.
Thank you for the information, Do I just go back tomorrow, and demand I get my logs back? -
He took them so you don't sue him.Like maybe you didnt have the hrs to make it ontime to your destination and your logs would show that if you're 100% honest with logging.Or maybe he was worried you would redo your logs and try to sue him for wrongful termination. The yellow copy I always thought they were yours to keep.Far as the white copy, alot companies won't give the drivers there final check until they hand in all their logs. What you do is chalk this company up as a bad exp and move on.

Best thing you can do is simply find another company to drive for and forget about those guys who fired you. As far as logs,I would get another log book I a truck stop and rewrite logs and pitch the white copies. That way you will have proof of experience and have them for per diem at end of year.
tucker Thanks this. -
Your company gets the white original and the yellow is yours for your records. I would call the office and demand them back and if they refuse, let them know you will obtain legal assistance to have them returned. You will need the logs to file your taxes.
Have you received your final pay settlement?
If you start work for another company within 7 days, you will have to use these logs to report your driving/working hours.
