If you're not filing any lawsuits. Forget the log book copies especially if you ran outlaw. You'll get in trouble too. Move in find a better company and screw it.

At the bottom of the log page it says: DRIVERS COPY I absolutely GAURANTEE that in and of itself would hold up in any court across the country as a LEGAL DOCUMENT that belongs to the driver.

oh gimme a break, how the hell is it larceny..??? got proof of that statement there driver..??
they (the logs) have no intrisnent value, he didn't buy them....they are in fact company supplied items...good god almighty.
driver, the "few discrepancies" , may be the reason why the old logs were taken away, to make sure, (for instance) that you were not running 2 or more log books at the same time.
we are required to keep our logs for the past 7 days. i always keep my log book (when completed), in my briefcase for the 7 days as well, then i leave it at home, in a box, in order of month, and year, for proof of not only my miles, but my time working.
if anything at all, in the future, keep only the previous log book (completely filled out) with you for maybe the same 7 days, into the new month, then take it home, or if you are on the road, mail it home, using standard US mail.
they may return your logs to you, IF they found no problems showing you were using more than one log book at a time and doing it properly.
for the record though, i have never heard of any company taking away the old log books, so they may "think" that have something against you.BrenYoda883 and Dinomite Thank this. -
Find another job man move on. If you have a clean record you'll have job in a week. Driver shortage is working for you. Tell the new employer the stuff that happened and they'll look past that stuff and hire you.

Do I have proof? Look at the driver's original post for evidence. We have to go by what he wrote. He refers to the property as "my belongings" and twice uses "my logs". He did not say the company provided or paid for the log books. If the driver bought them, they are his property. (This is why I qualified my statement and wrote YOUR in all caps. I wrote, "If the logs are legally YOUR property, then taking them is larceny.")

Larceny is a crime involving the unlawful taking of the personal property of another person. -
Yep. Why would a carrier take the driver's copies of the logs? I don't know who Opie ran for, but in our line of work, but it doesn't sound as if he has lots of work experience in the business. I keep all the logs, every OSOW permit for every load for proof of the various loads I've pulled. If Opie is fairly new, and has all of his experience at 1 gig, or even recent experience at 1 gig, this may hurt his bargaining power at his next gig.

Not true. Each page with sleeper logged is worth about $57.00 a piece. It is as good as a "Receipt" for per-diem at any audit. And a company is only required to keep THEIR copy for only 6 months (I believe), so if you had to fall back on them during an IRS audit...you can easily screw yourself out of proof for a minimum of half a year, if you ran a full year with them.BrenYoda883 and oldtrucker66 Thank this.
