I have received my first driving ticket in 20 years
After completing 4 weeks at CDL school to aquire my license i was informed that the "real" training begins with the 275 hours with a trainer. After two weeks the dispatchers began running us as a team. On one day my trainer told me he was sleeping till 9am so I took the time to do laundry and dinner. I didn't get in the sleeper until 4am so needless to say I was upset when my trainer woke me up 2 hours later at 6, telling me to drive. I drove for 7 hours through Colorado and my trainer took over. I went into the sleeper for 10 hours, but honestly didn't sleep too good. Anyway I took over again in Nevada and drove to drop a load in San Bernardino. Next had to bobtail to San Diego, but about halfway there I suddenly became aware that I was too tired so I began looking for a rest area to pull over. At this exact moment almost on que, my trainer hops in the front seat so I told him "I'm too tired and need to pull over", however he encouraged me to keep going to San Diego (about 45 miles) and assured that he would drive from there. I reluctantly took his advice. Then about 5 minutes later, during my first time in bumper to bumper rush hour traffic on the I-15, it emptied out into a 5 or 6 lane highway and I became overwhelmed and slightly confused about which lane to drive. So i did what could arguably be called a sensible response: I asked my trainer. I said "should I drive in this lane? I'm not sure". He responded "I DON'T f****** KNOW"! About 5 minutes later, as my trainer is literally smacking the quelcom and screaming at it (apparently didn't like a message from the dispatcher), I noticed the CHP officer following me. He pulled me over and asked why I was in the second to left lane? I had no excuse so I replied that I was sorry and was a new driver unfamiliar with that particular stretch of highway. He then asked my trainer "why are you letting him drive in that lane?" My trainer just said he "just woke up" which is a complete lie.
My question is what responsibility if any does my trainer have in this situation, and are there any people who can advise me on how I should proceed to deal with this ticket in court?
Thank you.
What are the responsibilities of trainers if any?

your "trainer" failed you, I would not want this clown for the rest of the training period. Sounds like a team environment/exploitation of the new driver. I would bring this up and mention a ticket and the dialogue with the company and get a new trainer. I would look further into the ticket for sure.

Get a new trainer. But u should of been aware of the posted no truck in left two lane sign. Tired or not it was ur responsibility to pull over sooner. Once ur on your own it's all you.
Get a lawyer. Fight the ticket.truckerlife74 and BeanDip Thank this. -
I've been in your situation as a new driver with a trainer. Its hard to say no without the trainer giving you abunch of static for it then it goes to the company and then you get called into safety. How much was the ticket?I personally would chalk this up as a lesson learned and if you're having problems with your trainer request a new one.But then again it could be a repeat of a trainer like the one you have now. That second to the left lane, was it no trks allowed in left 2 lanes? It's very important to read your signs.Next time in bumper to bumper traffic stay in the right lane or the lane next over if the furthest right lane ends or exit only lane.

The vast majority of the time, trucks are required to be in one of the right 2 lanes on interstates.

In todays trucking there are no responsibilities of a trainer far as their companies are concerned. Its ll about loads and money. Most are on team loads when the trainer should be in the jump seat at all times.

A word of caution to the wannabes...Don't train with a company that puts students and trainers in teams. Student can't learn if one person is always in the bunk.
