If a shipper mislabels a BOL as Hazmat (the hazmat column is marked, actually has UN id numbers on it, witht he emergency contact info etc) but the material IS NOT hazardous? Whats the penalties if its hauled. Had someone ask me this question, thinking I knew the answer since I have hauled hazmat but I;m kind of stumped. I know the shipper is responsible for proper labeling, what about in this case?

Needs to be corrected. If it's marked hazmat when it isn't the Enforcers go nuts, same as haz that isn't marked. Main reason is for proper response to emergencies involving same. Penalties vary by location.

Not sure for penalties but they have to figure out what part of hazmat is on the truck? None? Well why does BOL say it? You know DOT doesn't like to believe honest mistakes. So it is a big problem as you probably know already. But don't drivers look at their BOLs when loaded to check weight/adress etc?
You'll be surprised how many times a shipper will issue a wrong BOL. -

Hazardous waste . Treat it like the bill requires.

so if gets hauled, no placards, company not insured to haul hazmat, driver has no endorsement. whats the worse situation?

10,000$ fine . Possible jail time .

$10,000 + more investigation. May even have problems with insurance. I rather take my chances of scanning and editing the BOL with correct information.

See thats what i said. but the driver told me he was told by a "buddy" that mistakes happen. dont pay attention to the BOL, just the freight. oh well his loss...........NavigatorWife Thanks this.
