Like I said, contact OOIDA. They can tell you the law and even offered to negotiate for me.
Chances are I will not be hauling for that broker again but they are a dime a dozen anyway.
The biggest stipulation that I see is was delivery time and date written on the confirmation sheet and did you arrive on time.
Also OP hasn't been back here since her second post and probably not get any of this info. Maybe it will help someone else.Cottonmouth85 Thanks this. -

Could have been avoided if driver calls consignee to verify delivery times ! Right ?

Yes it was in writing that had to deliver by yesterday between 6am and 2pm. Not trying to sound like a smart guy , I should have called the consignee before we put the load on the truck?

I think the guys are just trying to make sure you've got your I's dotted and your T's crossed. You have to be 100% in the right legally before you can do something like put someone else's freight in storage and make them pay. It sounds to me like you did. The only other thing you could have done (and maybe did do) was call to confirm the delivery appointment. If I got confirmation from the receiver and then when I got there they refused delivery, I'd drop that load at a storage facility and let them pay for it and deal with it. They'll probably cry about it, but I'd rather have them crying about storage fees than me crying about not making any money. We aren't out here busting our hinders for nothin'.
