3406 B failed emissions in NY

    Which shop was that? Flushing out the intake after a blown turbo is pretty basic stuff, and any shop that would cut corners like that isn't one I'd let change a light bulb.

    It was the cat shop in Albany ny.
    It was called southworth cat at the time.
    The shop has long since been bought out and runs under a different name now.
    But the point is not what an inexperienced mechanic did.
    It is that OIL BURNS.
    If you have an un governed amount of fuel fed to any diesel (in this case unmetered engine oil being fed into the intake) it will rev uncontrollably till you either run out of the said unmetered fuel or you cut off all intake air or the engine self destructs.

    some one posted a thread a few years a go about a Detroit S60, after being overhauled the turbo crapped, was brought to the shop where a new turbo was installed, about a minute after it was started the thing started revving uncontrollably and every body was running around not knowing what to do until rods started flying around.

    this is one thing I try to teach new drivers specially new O/O, if something like this happens, you have a few minutes, may be only one minute, but enough time to cut the rubber hose between the Air to air tubes, I rather cut the one on the driver side, just in case the ATA is full of oil and deflect the direction of the tube up or down and it will stop in a few seconds after it finish burning any remaining oil in the intake.

    I know people will panic, I'm one of those, since I was burned from head to toe when I was six and was hospitalized for two month so the mental trauma still there, but I have a plan in my head if I ever encounter this situation whether it is my truck or some one else.

    It's really hard to see a motor grenade and do nothing about it, unless the thing it's going for a few minutes already, I would not risk injuries, but if I see it happening, I will execute my plan.

    and the point is,Yes it does happen, an electronic engine will run away, whether it revs to 4000 rpm or just over the intended limit, if you can't stop it, it's a run away engine. PERIOD.

    I got a call from the assistant DA yesterday. They recieved my evidence and letter of defense in the mail and they said they will be dismissing the case.
    .
    The crux of my defense was:
    1. SAE J1667 (the procedure for e testing) states that if the governed speed can not be determined, they must abort the test. Since the EPA tester couldn't determine where the governor was set, or if it was set, he should have charged me with failing to have a governor set but he shouldn't have tested for emissions.

    2. They charged the driver, not the owner.

    Where I live the judge will make you pay something, but not dismiss and sometimes that something was more than the ticket

    You'll find that NY ALWAYS charges the driver, regardless of what the violation may have been. Their standard line being "You should have discovered that on your pretrip and not driven the truck".

    BTW, congrats on the case getting tossed.

    Not sure how many guys would catch an ungoverned engine on a pre-trip. I've never seen a driver yet fire up his truck and put it to the floor lol.

    I have...and it is a sad sight. Cold fired, foot to the floor before oil had a chance to reach everywhere it needs to go. Ignorance is usually to blame, and if confronted about WHY they would do such a ridiculously stupid thing, "trying to build up air pressure" is the typical response.

    I have never seen anyone who foots the bill for truck repairs do this, though. They tend to take a little better care of the equipment they operate.

    I thought a lot about this deal and pisses me to think about it but I've come to the conclusion that if I was driving one of these trucks, I think I would move my actual exhaust down under the truck and leave the stacks in place up top. All this EPA crap based on flawed science and outright lies just pisses me to no end.
