Officer's blood-alcohol level twice legal limit at time of crash

    If you have read the article, the truck driver admits to pulling out of the lot when the car was only 300 foot away. It is possible that even if the police officer had not been drinking, he would have still hit the truck. So, if no alcohol was present, the truck driver is at fault.

    Now, considering the above with alcohol, the truck driver would still be at fault.

    To make matters worse. I believe there have been times when there has been an accident where one party was under the influence. It has been ruled that the accident was the fault of the party under the influence because if they had not been drinking, they could have avoided the accident. This is probably the true situation here.

    Well, that may be but the point is they will try to find a way to blame the driver. The older I get the more I really start to hate the police and their blatant abuse of power. We all know about stories where the officer was clearly responsible, yet what happens? The police don't quite say that the driver was responsible, but they try their best to deflect what blame away from one of there own. I too am surprised that he wasn't portrayed as a hero in the story. Now that I'm steamed I'm tired of every time they show a story on a Police officer they ALWAYS say that "when i leave home I don't know if I'm coming home". Hey Buddy want to take a gander on the most popular way to die unnaturally in the U.S? Traffic accidents, so maybe we deserve to say that and portray ourselves as having some type of dire job. Just my thoughts.

    Yes, they do know traffic accidents are the leading cause of "unnatural" deaths. Who do you think responds to each one?

    And why shouldn't the driver in this case receive some of the blame? He clearly was not practicing safe and professional driving skills.

    And do what when they get there? Call the Fire Department. Wow, real heroes. Had the shoe been on the other foot and the trucker hit the drunk cop then nobody would even think the cop pulled out to soon, oh no.

    Let's think about this... Trucker was unprofessional and pulled out with approximately 300 feet between oncoming traffic and himself. As a result, vehicle hits the truck. Regardless of who was driving the vehicle, the truck driver is in part, responsible for the accident. Why? Because he failed to yield as required by law. Or are you saying that truck drivers can break the law without consequences?

    Okay he had a share of the responsibilty. Everyone of us everyday does something behind the wheel that could result in an accident. I'm just sick and tired of cops being able to get away with things the rest of us would get charged with.

    Sorry but I agree with the Macho man on this one. Maybe this accident will finally make the FMCSA require drug and booze testing on ALL PARTIES involved in a fatal or DOT reportable accident. A drivers license is NOT A RIGHT IT IS A PRIVLAGE. I have a close friend that had someone hit him with a BAC of .24 yet the guys widow still won a million bucks. Why her atty got the judge to throw out the BAC on her late spouse claiming his Drinking and Driving had nothing to do with his accident.

    Exactly... And even truck drivers need to remember that driving is not a right and must follow the law at all times. I am not saying the truck driver was totally at fault. However, because he did fail to yield the right of way, he must share some of the blame of this accident. The fact that the officer was impaired at the time is totally irrelevant.

    However the COPS reaction time was 5-6 times slower than normal at that BAC. If he had been sober he would have seen the driver pulling out and STOPPED then Flipped and pulled him over. Beacuse of the Alchohal in his system he crashed at full speed into the truck Yes the driver has some responsiblity HOWEVER BEING A COP DOES NOT GET YOU OFF THE HOOK WHEN YOU ARE 2X the legal limit.
