Okay, see most of the ones they gave me copies of ( I'd say 75%) do not have my boss or anyone signature on. There is one in particular that I am concerned about. The copy of this one, that I made when I was out on the road says the rate is 1000.00. When i got back in the "company" gave a copy, but the rate is whited out (so there is no rate showing. On my pay stub they claim the rate was 800.00 therefore I received my % from that amount. I have three that are like this. The others match what I have. Hence the question. COULD the rate have changed between the time I received it when I was out on the road and when I returned.

Never heard of somebody changing the rate once the truck was dispatched but stranger things have happened. The fact that the numbers seem to be constantly changing is suspect. And without a signature the confirmation is nothing more than a piece of paper. Maybe they aren't getting the customer to sign and then the customer turned around and said I'm not paying that... The ICs would have more insight on the whats and whys dealing direct.

First, The rate confirmation you're getting from your company doesn't mean squat. It can be scanned, altered, printed and given to you. All that matters what got deposited into the company account.
Second, I suspect if you get the extra money that is owed to you, it will be enough to conver your increased tax liability.
Third, I am admittedly no expert in percentage pay but I find it difficult to believe a percentage employee isn't able to see the freight rates..... How is an employee supposed to know things are right?
Fourth, if I was this employer and I was confronted by a lawyer telling me to pay up or I would be reported to IRS, I would pay up, including my employees legal fees. See if can find a lawyer that will agree you work on a percentage of what he recovers but collect from the employer. They will say they didn't know, but they are theives... They know.
I think this as close to a slam dunk out of court settlement as one can get.Last edited: Nov 25, 2015

Yes. I can think of two instances where the broker changed the rate on me...both Landstar agents by the way. I simply ignored both of them and billed as per the originals. They squawked, but I said I didn't know what they were talking about and asked them to produce a copy signed by me and they couldn't of course. They weren't pleased but yes it can and does happen. Again...the rate sheet doesn't really mean anything IMO. Your carrier can edit that.outonalimb and Nighthawk325 Thank this.

i'm willing to bet that 50% of the truckers in this country aren't averaging 900 a week.
west coast freight don't pay as good as southeast coast. you've also got different type of trucking. such as oil haulers and dirt haulers and what not. hourly workers vs, % workers vs. set pay workers.
As for the OP. If he wants a % of the load, Is he going to pay a % of the bills?
You all say it's legal. Yet, none of you are paying for the fuel, truck payments, insurance, maint.
There isn't one company in the world that pays a % of the actual load pay. They'd go broke.

Beg to differ with you, my guys are all percentage and they see every rate sheet for every load that they run. That is the only way you can run an honest percentage program. They each rent the equipment or purchase depending on the percentage they desire and feel they can afford. They only run where they want to run and for the best rates available each load. We all seem to love it, and by the way none of us are getting rich but we are sure having fun doing what we like to do. When I changed my company to this style all of the sudden I seemed to get better operators, the whole rate per mile thing actually sucked for both the company and the drivers.outonalimb and Nighthawk325 Thank this.

Scott beat me to it but I always saw the rates for each load. Check stubs always matched receipts. If you want to cheat drivers more power to ya. But I don't see what's so hard about paying what was agreed to.
