Returning to time cards

    My last employer decided to use logbooks even though all the trucks operated within the 100 mile air rule. When asked at safety meetings why we were still running logbooks we were told that once they started using logbooks we couldn't stop. I've asked DOT officers and they laughed. They said company was lying and they were probably getting a discount on their insurance for running logs. I've looked in fmcsa book and can't find a rule about this. Anyone know for sure. The other employees that are still there want to strike to make them stop, ( if they don't have to run logs, then why take a chance on log book violations) I'm planning on going back if they stop running logs.

    HOURS OF SERVICE OF DRIVERS


    § 395.1: Scope of rules in this part.

    (e) Short-haul operations —(1) 100 air-mile radius driver . A driver is exempt from the requirements of § 395.8 if:

    (i) The driver operates within a 100 air-mile radius of the normal work reporting location;

    (ii) The driver, except a driver-salesperson, returns to the work reporting location and is released from work within 12 consecutive hours;

    (iii)(A) A property-carrying commercial motor vehicle driver has at least 10 consecutive hours off duty separating each 12 hours on duty;

    (B) A passenger-carrying commercial motor vehicle driver has at least 8 consecutive hours off duty separating each 12 hours on duty;

    (iv)(A) A property-carrying commercial motor vehicle driver does not exceed the maximum driving time specified in § 395.3(a)(3) following 10 consecutive hours off duty; or

    (B) A passenger-carrying commercial motor vehicle driver does not exceed 10 hours maximum driving time following 8 consecutive hours off duty; and

    (v) The motor carrier that employs the driver maintains and retains for a period of 6 months accurate and true time records showing:

    (A) The time the driver reports for duty each day;

    (B) The total number of hours the driver is on duty each day;

    (C) The time the driver is released from duty each day; and

    (D) The total time for the preceding 7 days in accordance with § 395.8(j)(2) for drivers used for the first time or intermittently.

    I write a log to make the company happy, but we operate in lock step with 395.1(e). Inside 100 miles, 12 hour shifts, etc. I do not carry a log book or any other such paperwork with me...it stays in the car at the yard, and I fill it in when I get done with my shift.

    No point in giving DOT any more ammunition.
