1099 as a company driver.

    When you get hired as an employee and then a few months into it they turn around and say your a contractor.. well the cards have changed now don't they. No longer work there so now I am neither. Appointment with Attorney next week.

    If you do get a 1099 file a form ss8 with the IRS and pay your part of the taxes only .This should determine if you were an employee you are using there truck running under there name and dot # you are an employee. You don't want to pay more taxes than you have too.

    Your part would just be federal income and FICA taxes witch is mandatory but you would be paying a lot less than a 1099 and without the deductions that an owner can take.

    Unfortunately, some drivers have to go to the 1099 companies due to a not so perfect driving record.

    You forgot the workman's comp insurance, the unemployment the company pays per employ and the company share of your Social Security and Medicare. Those are big reasons those shysters want 1099 employees. It's one of the favorite scams of companies that for the most part are run by people with very un American accents.

    Not the case here.. My driving record is spotless and if i am hired as an EMPLOYEE they should not be changing it up two months down the road trying to claim I am sub contractor..

    Yeah well this company keeps digging their own grave.. they were sent pay discrepencies(mind you they only had 1 employee..me) how do you mess up on 1 employees pay..like seriously), they paid them and now are saying i damaged their truck.. FOOLS.. I took pictures of the ENTIRE TRUCK when I walked away from them...

    "Complainer"? Your darn straight I am complaining. You stay out for three weeks and make less than 500 bucks, see how much you complain. Everyone has an opinion though. I want something done to this so called "company" for them cheating drivers out of money they have rightfully earned. If its not me they pay, so be it, but I can't just sit back and let them continue to scam hard working people. They SHOULD NOT be running a trucking company AT ALL. When a "Company" can't pay the 1 and only employee they have correctly and its proven, nope they should not be in the business, period!

    The first question that a driver, seeking employment, should ask an employer, "you pay under 1099 or W-2". If the reply is 1099, you don't want the job, walk away.
