and It never got done, that is so typical with companies.it's like that's a waste of good paper because nothing gets done unless you physically take the equipment to the shop.

From now on I would check the trailer even if you wrote everything up before taking it.mechanics aren't going to look at your logs and doubt even the log dept looks either except to make sure it's complete.

No, it don't work like that. If these violations were part of an inspection and listed on the long form they will count against the company CSA score, however the company will not be fined. I have never understood why some people can't seem to understand that when you operate any type vehicle on the highways its YOU THE DRIVER that is held responsible for its operation. YOU THE DRIVER are the one that is to make sure all the permits are valid. YOU THE DRIVER is the one to pre-trip the vehicle. When a law enforcement officer stops you and finds any violation its YOU THE DRIVER that gets the ticket not the company. I can't tell you how many times I have seen a driver (just) get in a vehicle after their 10 hour break with no pre-trip of any kind and start burning diesel. I have seen drivers do this with flat tires. Just get in and drive. I seen a guy once who drove for MBM leave a McDonalds with both of his rear doors wide open. No thought whatsoever to what he was doing. One of his doors just missed hitting a car by inches as he pulled out onto the road.

The judge told me it would not affect me as a driver, but may trigger a DOT audit on the company I work for. The second time my boss went alone.

Sorry chief, all tickets that appear on your record will be used against you by your insurance company. That is just the way it is. It is just a money grubbing game for them. There was a time when that was not the case but not now.

Since all CDL tickets go on your record some states assess those tickets towards suspending your license. So, one stop at the weight station you can get enough weight tickets and equipment violations to get your licensed suspended by the state department of licensing. Try to get a trucking job after your license has been suspended. That ain't going to happen. That is the case here in Washington state. 3 or 4 violations of any kind in a year your license will be on probation and another ticket or two will get it suspended. People have lost their CDL for just overweight violations!

People have to take a stronger stance against employers that refuse to fix their trucks. I know I have butted heads many times with a lazy cheep employer or mechanic. With this new coercion ruling maybe more drivers will take the initiative to show some backbone.

    NO NO NO
You are mixing everything into one thing and your conclusion is wrong! First insurance companies go by points as well as other factors. As far as personal insurance goes they only count moving violations against you. I got a lights out ticket in Missouri in 2010. I actually asked my insurance agent about this since I thought it might be considered a moving violation. They told me no its not a factor to determine my rate. All tickets if reported to your home state do go on your record but most of the time only things that draw points are used to take a license action. I have never heard of excessive non-moving violations getting your license revoked or suspended. If you don't pay them then your in danger of this. I think you are mixing up license actions with getting disqualified under CSA-2010. Being disqualified under CSA-2010 is not the same as getting your license suspended.

I am in 100% agreement with your last paragraph however. I also have butted heads with carriers because of being told to drive something I feel is unsafe.
