Carrier ,broker gag law

    Is there anyway to get around it?i would like to go directly to shipper but I don't exactly know the law.also can a broker sue the shipper or just the carrier?

    You must look at contract you signed with broker 1st thing most have a (back door ) or time limit on when if ever you can haul for shipper after loading thru broker, if you have hauled loads before you 1st ran loads them thru broker it makes a diff. but ck. with ooida or your own trans. lawyer before you make a move for loads, its a small world an brokers find out fast when new hauling contracts are signed?

    Each broker has a different clause in their contract. You can't directly solicit yourself, but if customer asks for your information then it's different. Small talk gets made over the truck and it eventually leads to them asking for my info. Again they need to get your information willingly. Just make sure that your broker contract doesn't state that you can't directly haul for the customer.

    Was the broker that hired you, hired by the shipper or receiver. If the receiver, then you should have no contract forbidding you talking to shipper. Because the receiver was the brokers customer.

    The shippers want you to do it for free like the brokers do. And if a shipper will put the screws to the broker soliciting you they will do the same to you for 2 pennies less as well. I never solicit when picking up for a broker
    I always do it on my "own" time and moths or a few years later.

    If your using the broker to find out who's got loads and then get loaded why would you think of being a liar and cheat and stealing work that they gave you? If you find the work on your own outstanding. If they got you loaded and then you try to stab them in the back what kind of person does that make you? I am not a broker and I have never been. The brokers we use sometimes to get us back from Houston or Dallas are paying over 2:00 a mile for flatbed stuff, that's most of the time not every time but without that I wouldn't know who to call to get loads. If everyone has such a problem with brokers whoever you are, do not ever not one time use them when your in a pinch or just really need something. If you do use them and then talk negatively you are nothing but a hypocrit and a liar. The ones that don't pay of course are horrible people but that's all part of business.

    Easy killer. You just dreamed up a whole scenario that's wasn't even the case.Unless you know the reason for asking I wouldn't go around calling people liars,cheaters and hypocrites.

    There is a "rule" but not a "law" that's called "back solicting", but there are ways around that law. This is trucking, and biggest laws enforced are upon drivers, than carriers. So go for it.
