I have had the business since 2010 being leased to bigger trucking companies and in March 2014 opened my Operating Authority. Being a family business the time has come where I have to stop driving and manage the business. What I can offer is my best judgement based off my experience in this business as an Owner Operator and as a business owner. My priority is to keep the wheels moving and to make my drivers and owner operators as much as they can while being out on the road and getting them home when they want to be and need to be. Company driver and 1099 = illegal in most cases. Does your company driver pick their own loads, own route, own hometime? No? Then they cannot be classified as a 1099. It's is a misclassification and you are open to lawsuit and heavy penalties.

Look at what's happening with Uber. The contractor drivers are suing for misclassification. Port drivers in Long Beach and LA sued and won. You have to hire a lawyer and Sue for all monies you would have had if you were a W2 employee. Medicare, social security, workman's comp... You can probably even get missing overtime pay (even though you wouldn't normally). But, IANAL, so I suggest you talk to one.
