    Publication 463 from the IRS

You can do either, but not both in the same year.

Special rate for transportation workers. You can use a special standard meal allowance if you work in the transportation industry. You are in the transportation industry if your work:

    • Directly involves moving people or goods by airplane, barge, bus, ship, train, or truck, and
    • Regularly requires you to travel away from home and, during any single trip, usually involves travel to areas eligible for different standard meal allowance rates.
If this applies, you can claim a standard meal allowance of $59 a day ($65 for travel outside the continental United States). Using the special rate for transportation workers eliminates the need for you to determine the standard meal allowance for every area where you stop for sleep or rest. If you choose to use the special rate for any trip, you must use the special rate (and not use the regular standard meal allowance rates) for all trips you take that year.

If you're a company driver and are withheld taxes you're better off taking a pre-tax per Diem.
Because you would have to deduct otherwise on a schedule A which most people never reach the
    standard deduction amount.

You can't deduct meals, you can only take the per diem rate and that's all. The caviet is that you have to be out for more than 24 hours which means if you leave at 1pm on Monday, you can't use Monday, you can use Tuesday or prorate the half day on Monday.

After a 3 year audit time and dealing with the IRS auditors, appeal officers, then going to tax court and success. I would be skeptical of anything from an IRS auditor.

The IRS allows for deductions day out and back, but at reduced rates. They are in the publication that I linked above.

I agree on the skeptical part. I took my IRP to the tax tribunal it's all kangaroo court.
I read the meal/per deim section and there's a couple ways to claim it.
Main thing that I read was whatever method you use to use it consistently for the whole year.
You still toting RV's ? They paying any better now ?

Still doing it. The rate has dropped just like all of the trucking industry.

If you are a company driver and your company is worth anything they can provide a report of your yearly activities, by date and locations with truck and trailer #'s. If the IRS ask.

We are still at 1.32 for the smaller units, 1.43 for the larger.
