This is Benjii, Steve's friend. Last year Steve had to give up car hauling due to severe neuropathy.

I just had a physical even though I have taken a sleep apnea test that plainly states this patient would not qualify for Cpap the so called doctor would not have this told me I had to have a sleep apnea machine and wrote it all up that I have to retest . Went to place I had taken it first time to retake it and Doctor was shocked that she looked at papers I took with me and didn't know what they said in short he told me everything was the same and I had lost weight and in his opinion it was a waste of money to do it again but by what she had done didn't really have a choice but he knows I don't have it and she still want go along with it she says I have to have a sleep apnea machine but why if I don't need it do I have to go to that expense if I don't need it talked to state dot they don't care was their exact words sleep apnea means nothing to them talked to state fmcsa pretty much same thing it not law yet but dumb examiner bout to put me out of truck over it anybody know if ooida would represent me or know of any really good lawyers if I get put out for no good reason other than this will lose everything I have worked for in a bad mess over stupidity of dot examiner

It's rediculous. Last year, we moved from Arkansas down to Louisiana and we had somewhat the same issue with a new doctor in Louisianna who wouldn't pass my husband until he showed 3 months sleep history on his CPAP machine. We didn't volunteer the information initially to her in his paperwork, that he was advised to sleep with one because he didn't think he had to since this sleep study was done per his request anyway. Anyway, it turns out, she called his heart doctor and was basically looking for reasons not to give him his 2 year renewal on his Medical Card.
After 2 weeks of talking to his Arkansas doctors and having them call and explain the whole situation to this doctor, over and over. I had everyone calling, from his heart doctor to his old family doctor to the doctor who actually did the sleep study 10 years prior, and even after they all told her he wasn't sent for the sleep study, he requested one, she still refused to pass him without the SD card containing his most recent sleep history of him sleeping with the machine on. I was livid at this point and started feeling as if it were very personal so I said some pretty choice words to her and some of her nurses who were proving to be very unpleasant and difficult to work with. I mean, it's frustrating that these guys are tying to work and make a little money (most of which gets paid back to paying for tags, road taxes, fuel taxes, state taxes, medical fees and any other fee the federal government has decided needs to come out of our pocket to support their bailouts) and then, the FMCSA wants them to jump through hoops backwards just so they can go to work and be someone who pays their taxes. Hell, I would think that would be rewarded and thought of as admirable, rather than sitting at home on your dead ###, drawing a check, pretending to have a medical issue, like so many people are enjoying doing.
Anyway, what we finally had to do was just go to another doctor and get his physical completely redone. We didn't mention the breathing machine the second time and it was never brought up. This doctor passed him without any hesitation. I think it just depends on the doctor, about the size of the stick they have shoved up their ###, about if they're going to judge a person case-by-case or if they're going to go by a checklist that is supposed to be uniformed to judge every single person who walks in by the same rediculous standards.
I hate it too, but unfortunately, that looks to be the way this cookie keeps crumbling and will continue to crumble...
