Doh, you are correct.

Yeah as long as you're not driving under the influence and your company doesn't have rules against drinking in the truck there's nothing wrong with it. As far as nyquill and other such medications that just sounds ridiculous and I'm sure only the biggest ####### dot officer is going to even look at it twice, so long as, again, you're not operating under the influence of the medication.

It's illegal to have any Alcoholic beverage in a CMV, that's a DOT regulation. It doesn't matter if it's never even been opened or not. I don't think mouthwash counts. If your taking any kind of prescription drug that influences hour ability to operate a CMV you have to notify your companies safety compliance department.

What DOT regulation? There is not one.Last edited: Feb 2, 2016

Gonna cost him and the company a lot of cabbage!
austinmike Thanks this. -
You might be right. I see where it's illegal to operate while in possession , but nothing where the FMCSA prohibits it, specifically.
And @Air Breeze , just because someone might want a few drinks, doesn't mean they always have to be drunk all the time.
I've met drivers that won't drink on the road, but when they get home they have to get wasted for 3 days straight, I think that's odd.
finbyrd Thanks this. -
if you fail a non-dot alcohol test does it show on your DAC report.
-
It's completely up to your employer. Some companies don't even use "DAC"

If it isn't DOT then its a Federal Law. I am pretty certain it's prohibited. I'll look it up later to verify what I said.tucker Thanks this.
