Defenses to IL town overweight ticket

    Is it a mitigating factor that the state of affairs in this country caused the liberal shipper to hire spoiled youth and social justice warriors that loaded the trailer overweight?

    You are right, I forgot about that truckstop. I grew up in Elmhurst and the Elmhurst PD is looking to generate $$ for the city. You can probably argue that the local police are not certified to operate the portable scales, because honestly, to be 5000 lbs overweight on tandems is a lot

    Not in Elmhurst, they have their bases covered and generate LOTS of revenue. :mad:

    That's north lake on one side Melrose on the other. And no it's not a truck route. Signs clearly say that from 83 and north ave heading east is prohibited

    As I see it, you may be able to argue that the local officer made your driver deviate from the route he was on. A route where he was enroute to weigh the load on a certified scale. That will only work if there are not other certified scales available on the route he was on. But, you are gonna pay something. I'm sure there is no way around that. They may lower the fine some, but most likely will not throw it out entirely. Your trailer was overweight. Unless you can conclusively prove your trailer was not overweight when ticketed you will pay something. You'll have to see if fighting it is cheaper than paying it. Drivers need to go to the closest cat scale available, even if it is a little out of the way. He may have been doing that. Good luck.
