I dont know what it is about that water, but Pepsi is about as bad as Kapstone about rejecting it. If the load is leaning, youll probably have to restack it to get Pepsi to take it. Of course, I have seen drivers go in Pepsi and there would be water bottles laying all over the trailer.
KeithT1967 Thanks this. -
IMO I'd take the loss and try not to get in the same situation going forward.

Well this was pretty unavoidable noway to have foreseen this and no real way to prevent it from happening in the futureBadmon Thanks this.

Walmart tried thus with me in louisanna. Wanted me to drive 69 miles to baton rogue to get it restacked.
When Walmart found out i was going to donate it to the nearest fire department and use it as a tax write off on taxes, and put a claim on my insurance they just unloaded me.MidwestResident Thanks this. -

From the pictures of the rear, it doesn't look that bad. However, as you go back into the trailer, usually, it gets worse. I speak from experience. They probably were right to deem it unloadable. The problem with water is you usually have to restack the pallet once it starts leaning. I would have asked to restack it myself. It might take me all day, if they let me, but atleast you would have only lost your reload.

You can talk big all you want but in the end you have no leverage at all. If you don't deliver the load you can be charged with theft. If you give the load away to the fire department they can make a claim against your cargo insurance. On top of that you won't be paid at all by the broker since you didn't deliver the load.
Unless it states in the rate conformation or the carrier agreement you originaly signed you get screwed. I assure you there is nothing in either contract that allows you to do anything other then deliver the load or bring it back.
You can cry all you want but in the end your insurance company will pay the claim for the cargo and your rates will go up or insurance cancelled.
The days of John Wayne are gone were you punch someone in the face and that's the end of it. -
No they don't!!! Anyone can reject the load for no reason at all and tell you to get lost. Don't want to? They call the police haul you away and tow your truck.
