We do what we have to keep making money. But I definitely would tell the dispatcher it is not a hot load or I would already be rolling with it .

Question 5: Do telephone calls to or from the motor carrier that momentarily interrupt a drivers rest period constitute a change of the drivers duty status?

Not a good idea to send a loaded message when you're supposed to be off duty or in the sleeper if the DOT pulls your logs. Even worse, if you get into an accident and the lawyers and prosecutors get a hold of your logs and see that you were working when you were showing off duty then you're really screwed. I've waited until my break was over to send a loaded message, but if they really dig, they could call the shipper and find out when they finished. Like you said, the best thing to do is to go on duty for that time you pull away from the dock and close the door then park. Then you can do an 8 hour split break in the sleeper. It isn't worth losing your house, your savings, and possibly going to jail.

So, when they call you at four in the morning and wake you up because you haven't responded to the load they sent you over the QC, that isn't interrupting your rest?

The lawyers think differently. We have now been advised to turn off our phones on our 10 hours. Lawyers are pulling cell records and successfully arguing that drivers could not have been rested if they were making, answering and sending texts for most of their 10 hour rest break. The government is one problem - the lawyers are a whole different animal.
What ticks me off is that the large fleets implement these draconian and stupid procedures (speed limiters, eld's, cams, etc) in order to reduce their liability and thus their insurance expenses. Once they realize that it puts them at a competitive disadvantage, they buy some politicians to shove it down all of our throats in order to level the playing field that they screwed up to begin with.scottied67 Thanks this. -

Why is this whole Log thing even an issue with all these pinpoint issues?
I mean really...As im on Paper The LAST thing I ever think about is a log..(Irregardless or paper or electronic)
The Only time I ever Log Anything is when I leave My Property....Weekends, Working On them,Fueling Them On my Property, Towing Them,Partying Around Them ,Etc....... A Log Book doesn't even cross my mind, never Did.
