OK, so what's the answer? We're all experts ( me included) on what went wrong, but how do we prevent this foolishness in the future? I don't know the answer. I just can't figure it out. Cars ( and trucks) get safer, reducing highway deaths, then something like the cell phone comes out, and erases everything we've strived for in making vehicles safer. By all rights, LESS people should be killed in crashes, not more. I'm 61 and I don't ever care to drive again. I never thought I'd ever say that, but it's out of control. People aren't going to give up their cell phones, like giving up booze or cigarettes or drugs. I do have children that barrel up and down the highway, and I worry tremendously about this. I've tried to tell them everything I've learned in all my years of driving, and to watch the rear view mirror when stopped, and not singing songs. I bet this was the last thing on the driver of the van's mind. I know this sounds bad, but the whole family went. You always hear of like 1 family member survives sometimes. Can you imagine how hard that would be? Tell your loved ones to be aware something like this can and does happen, and watch that rear view mirror. This is going to be with us for a while.

Hi Dave, I was typing. That was before we knew what happened. And I still say, it's not like he planned to do this. We are human and we will screw up. Again, this is the price we pay for a modern society. Do they still have the firing squad option in the US?

And the fact that he didn't plan it this way, or he is someone's cousin or dad, that counts for 0. The fact is those people are dead, and he killed them, anything else is window dressing. -
There certainly are "crimes of intent." Very few motor vehicle deaths are in this category.
BUT, nobody has to PROVE "intent" in motor vehicle crashes. Vehicular homicide is specifically NOT a crime of intent. You are responsible for the deaths that were caused BY YOUR ACTIONS.bzinger and Dave_in_AZ Thank this. -
I'm certain there was no malice involved on the part of the driver. Gross negligence, absolutely.
Few things grind me more than people that think motor vehicles are a game or a toy.
In 2 years we lose more people than we did in 'Nam. It's unacceptable. It's not necessary for us to go about our day to day lives. -
The next legal battle if the major carriers catch a whiff of it is this. People will probably complain they have to install an app as a part of their employment but those will be the larger abusers of the system.

I keep an eye on this section because I look at coming into this career knowing all good and bad aspects. -
Oh there's brokers that already want to track you through your phone. Some shippers as well.

Hi SBH, well, to be honest, millions of drivers drive millions of miles without incident. You just hear about every crash, like motorcycles. Don't let this deter you from driving, but it's good you are paying attention. Cell phones are here to stay, even if outlawed, people will still use them. Just keep your wits about you, and that call can wait.
