Western express bad company

    Anything you do in a personal vehicle is now merged onto your CDL. A lot of people at trucking companies who are recruiters are not even aware of this, its not their job to know, even though they should know.
    They probably saw the seat belt violation and deemed the op a safety risk because they are worried about the companies safety score going down.

    With all due respect, when you mentioned you already had your CDL before you went to Western Express and they want to charge you $3,000.00. the light bulb went on. You were going through their in house refresher program, am I correct? in this case, I see where you got the breach of contract from.

    My mother in law is an attorney and she sees breach of contract cases all the time. I am going to let her jump in here and give her two cents as she is at my home right now.

    Sir, did you read what you were signing? there should have been a clause in the contract that states under what terms they can rescind their involvement in the contract and cancel it out and what the specific damages are to arise out of the rescission. Always, always read what you are signing and not only read it but understand it and what you do not understand, get clarification.

    Without reading the contract, I can say that you probably don't have a case for breach of contract. With a lot of trucking companies that offer their own training program, anything discovered during the term of the contract that is deemed to be an issue and a seat belt falls under a safety issue, is often grounds for termination of employment which comes back to any contract signed.

    The question I have for you is did you disclose this to them when you applied because my son in law is going there in a few weeks and they ask on the application form that's on their website, about any things of this nature.

    Also, anything a recruiter tells you is said in the sales/recruiting process, and can become null and void, once you get past that stage, i.e. at Western Express.

    My mother in law who is an attorney just replied to the op. I believe he told them his driving record is clean when he applied and they discovered it after he was in orientation and they crap canned him because they sat there and figured that if he isn't upfront about a simple safety belt ticket, what else is he/she hiding and weren't about to try and find out.

    That doesn't surprise me, Chinatown. I guess he/she figured out that we were on to him/her and that most of us here are not dumb truckers and that we actually have a brain in our head.

    The lesson he/she learned I am guessing is to be upfront and honest about even the smallest things.

    Most companies (not just trucking) have "full disclosure" agreements written in the contracts which means even something we may find trivial we (as potential employees)still have to disclose it to the potential employer.

    Bingo... sue them... they should have had their snit together before telling you to quit your job... might be cause for you to sue them for something... breech of verbal contract.

    Trouble with some of these companies is that they wait to see who actually shows up before starting to cull the herd down to the number they actually need and then the individual that quit their job gets screwed.

    The point I hear is that a company should do their homework before offering a job to someone before even getting the standard reports back with which they should use to exclude drivers... LOL

    But they don't. So the IMPORTANT thing for the job seeker is to ASK (phone or in person....NOT stupid email) someone other than a Recruiter (i.e.- saftey department, vice president, etc...) "am I 100% cleared for employment...may I give my current employer notice".

    And don't lie or hide things on your application!!!!!!
