States Exempt from paying overtime?

    Hi guys,

    I am currently working for an LTL company in Portland, OR. In Oregon, transportation companies are exempt from having to pay overtime. Right over the border in Washington, the same company is not exempt from paying over time to transportation drivers so the drivers in Washington get overtime after 40 hours. I was thinking of moving to a new state and transferring through my company since they have locations all over the states. Could somebody help me out with a list of states and which ones are exempt from the FLSA? My company is a great company, but would be nice to get over time :)

    ps, I am not interesting in moving to Washington lol, looking to move somewhere warm.

    If your motive is to move someplace more warmer, then I say best of luck to you for that. If it's simply just a move to get OT pay, I'd then weigh out the options in terms of cost of living comparisons etc., just to try and capture a few more bucks a week. It may prove to be detrimental.

    FLSA has nothing to do with the states, they can require a company to pay ot or the company can just pay it on their own. The FLSA is a federal law that applies to all the states equally and for us, we are exempt from ot throughout the country under that law.

    Just a political note here, if we wanted to do something about it we would start demanding that we are treated like professionals but the problem is the quarter of the people who want this wouldn't be vocal enough to get it changed. I can't see how a pastry chef or a manicurist or a salesman is considered skilled trades or professional.

    Just because theyre exempt mean some companies won't pay ot. I work in food service and we have a wharehouse in portland and I know they pay ot and doubletime.

    I live in socal, companies like jb hunt won't pay ot but most reputable decent companies out here pay ot after 8 and double time after 12

    Washington also has no personal income tax! It's cheaper to live here than Portland too....

    Are you sure you don't want to work in Washington?

    Trucking is except in all states at the Federal level. GOOD companies still pay it and all Union companies pay it (typically OT after 8hrs). Don't waste your time with a company that uses that as an excuse to not pay it, that's all you need to know about their mindset towards their workers. Can't trust them to be your "career" at that point.
