I thought if you moved freight that originated or ended in another state (country), whether you as driver crossed state lines or not, fell under the authority of the FMCSA. Therefore, most CDL drivers by default are under the thumb of the FMCSA. Technically, he could/should still face federal charges.

Sadly, I've encountered several drivers on this forum who have encouraged other drivers to not reveal past histories, including medical issues, legal issues relevant to their hire-ability with new companies, etc.

I specifically remember a recent post where a new driver entrant had a current back injury lawsuit with a previous employer and was encouraged by several guys here not to say anything about the injury.

    To which I was flabbergasted.

I haven't been in the transportation industry that long. However, I've already met plenty of drivers that prefer to do things illegally in the name of making "money". I'm sure it's not the norm but it is rampant.
