Ive been told that,, when trucks are backed up to the highway the scale is to put the sign to closed to let trucks by so there isnt a wreck,, ive also seen many a driver go on by when this happens and nothing comes of it,, i wouldnt stop when trucks are back to the road,, keep on trucking would be my motto.

are there any cops or dot or safety people here who could give a clear answer?
running the scale makes the most sense, but it would nice to have chapter and verse which gives us the green light -
I agree, it's a state to state kind of thing & judgement call.
Then again there's TN where if there's a truck pulling into the scale.... most drivers consider the ramp full & drive on by.

I have seen a sign in one state that tells drivers waiting for the scale to use the shoulder . I bet they'd nail you for running that one . I think some scalemasters listen to channel 19 and will close the scales if they hear a driver say they're backed out in the road .

the worst i have seen is virginia on 95, south of the maryland line, i have seen that line a mile long (no exaggeration) with chase cars waiting and no indication of what recourse to make

You're not going top get a clear answer. There is no Federal Law regulating this. So it is left up to the individual state.
Most states that allow you to bypass during backed up traffic, have it clearly marked on the highway, that you are allowed to. More and more states are becoming aware of the legal issues surrounding the practice of leaving the scales open and forcing trucks to wait in the road. As they get their ### sued off, they are changing policies, or closing scales.
Even with all that said....there are instances that scales will look the other way. The choice is one you have to make yourself in those cases. I've run scales before and never been bothered. But I fully expect to get hit with a fine, at some point. For now I play the odds....kill someone, or chance a ticket. -
It's the same deal with roadside DOT checks . Would you stop on the shoulder for a level 1 inspection ? I was stopped for a level 1 in Ohio yesterday . The officer pulled behind me and put his lights on a mile before a rest area . I slowed and drove on up to the rest area and parked there . No complaints from him . I travel that route all the time and have seen plenty of trucks stop on the shoulder just before the rest area . (Yeah , I passed and have new CVSA stickers on the tractor and trailer . )
