You are supposed to be enrolled and tested BEFORE the wheels start turning. Even though you hired help you are still ultimately responsible.

Automatic Failure of the Safety Audit
A New Entrant will AUTOMATICALLY FAIL the Safety Audit for violations related to:
Alcohol and Drug Violations
- No alcohol and/or drug testing program.
- No RANDOM alcohol and/or drug testing program.
- Using a driver who refused a required alcohol or drug test.
- Using a driver the company knows had a blood alcohol content of 0.04 or greater.
- Using a driver who failed to complete required follow-up procedures after testing positive for drugs.
i would enroll now and plead your case, say you thought it was taken care of and you found out it wasn't when you were getting ready for your audit and that you took care of it. i think they will probably be ok with that. but showing up to the audit not being enrolled would not be a good thingtbdieseltrucking and TallJoe Thank this. -
Nothing to lose, if enrolled now. What does it cost? $150 per year is what I pay. Otherwise, they indeed may suspend the authority, and the MC# will be stained with it too. To go through another enrollment, new MC# and Insurance. ... not worth not trying to get this resolved now.

by the way i am threw cmci. witch is threw ooida, you need to be a member to enroll but you could have it in place within an hour and necessary paperwork e-mailed too you and printed off showing you are enrolled. it was not a hard or long process when i enrolled. had necessary paperwork and was down pissing in a cup for my pre-hire within an hour. results take a little longer to come back but regardless you will be able to show that you are enrolled and compliant. they also automatically send you any updated paperwork for your file as required to keep you compliant going forward.

New Entrant Audits aren't as complex as full Investigations. Still you want to be prepared for them. Everyone is correct in saying you want to have your drug and alcohol consortium in place. This can range from $50 and then a little per driver and sometimes up to $300, so its good to shop around. The random consortium isn't everything they'll look for. You also need all the files and paperwork as per FMCSA rules and regulations. Just try to follow the rules as best you can if you're up for a New Entrant Audit and you'll do just fine.
