Honestly, I think it should be held to the same standard as alcohol. Not in the truck, not in your system when you are behind the wheel, but when you are off-duty, that's your own time.

Yes you can fire him, you don't have to have a reason for it.
This country works on the premise of at will employment with a couple exceptions of states that limit the termination of an employee.
If he has a disability he has to make that request for accommodation before, he can't just show up high and expect him to be allowed to work there then claim a disability without proof of it and that proof also has to be aligned with the treatment. I've been through this before and know what is allowed and not allowed. -

Employees in Ontario are employed at will and they can be terminated at any time that is true. HOWEVER if they are fired without a reason, they are due a severance package. That can get very, very expensive in a case where an employee has "issues" and might be unemployable elsewhere. I suspect it's the same in the US.
Also, you can bet your roach clip that if a Canadian truck driver has a prescription for weed, he will tell his employer ASAP. Employer has a duty to accommodate the employee's disability within reason so that means the employer has to bend over backwards to find a gravy job that the employee can do, and from my experience, the employee will suck at the job (can't work too hard), sleep on the job (pain takes it's toll you know), call in sick (worked to hard the previous day) and you can't do a #### thing about it.
Even worse, if the guy doesn't have a prescription, all he has to do is say he has a substance abuse problem and you can't fire him then either so long as he is undergoing treatment.Last edited: Mar 24, 2017
