No radio use in Tucson area!

    Obviously this probably was originally aimed at cell phone users ... and commercial drivers are restricted by federal law from using a handheld phone ... now no CB either ... for us!

    Pima county outlawing two-way radios... (Please forward this email to all club members).

    Club members: Please draft and send an email to all five county supervisors in Pima county. So far, they have only heard from two of us on this subject! Communications engineer David Branson (KC0LL) has given his permission for me to forward his email below to radio clubs. Here are the email addresses for all five Pima county supervisors. Send them a short (or long) protest email! Quantity counts.

    The County Attorney told me this is a primary offense, so if they see you on a radio, they pull you over.

    I have been on the phone all day with the Sheriff Office, County Attorney, Clerk of the Board of Supervisor and others.

    I sent all 5 Supervisors a long letter about this. Two have already responded and they had no idea they just outlawed their PC Win system and County;s 2-way radios. One called all upset and told me this was why he didn't vote for it. He said I was the only person that has contacted the supervisors about this, but I made an impression with them. One said he was getting with the County Attorney to see what needs to be done.

    Other people should email the 5 Supervisors about this.

    I understand this is phones too ... of course law enforcement and emergency personal are exempt from this "dangerous" practice ... somehow it is safe for them to use a phone or radio while driving ... over the speed limit ... but us "little people" are somehow supposed to know they are just looking out for us!

    Also...in their definition...a radio is not designed to recieve calls...or am I wrong in that...

    Flagstaff tried, but it got thrown out, like I'm guessing this will too ...

    My radio (s) are designed to receive "calls" ... maybe not "phone calls" but ... still calls ...

    What is interesting is that in the exemptions under #3 they list school bus and transit drivers ... which are prohibited by federal law for all commercial drivers!

    And they forgot to exempt all state/county/city road crews too ... bet they will be unhappy too!

    It'll get thrown out just like every other one in the country that someone had the balls....because no local county etc govt has the legal right to supersede or write state law....until the STATE passes the law it is illegal and unenforceable....this isn't state/Fed...this is local state and local municipalities....no matter what size....exist at the pleasure of the state....lots have tried all challenged have failed....its high school civics folks

    I think cities and counties can write their own laws besides state and fed.

    California for instance. Tough to find truck parking in pretty much every township. Mostly.

    "Engage in calls" covers that. Sending, receiving and actually using.

    Sorry to disagree with you here olhand, but, city and county ordinances are perfectly legal. You see it all the time.

    Sorry to burst the bubble of those who don't get this, CB radio like Amateur radio is only regulated by ONLY federal government, no state or local law can impose a ban on the use of a radio. They can try to do this but it has been thrown out since the communications act of 1934 had been enacted and will continue to be thrown out.

    On top of that, the state and local laws technically do not regulate cell phone systems and the equipment that you use, that is only through the federal government. I have seen some connections to allowing the state and locals ban the use of it while driving but there has been also talk by some in the legal world to challenge this in court based on the same reasoning that allows the feds to regulate the radios.
